Néstor Luis Ibars (64) returned to prison. The Judge of Criminal Execution No. 1 of Bahía Blanca, Claudio Orlando Brun, suspended the home prison that he had been granted on April 7, for being a person at risk for contracting the coronavirus. He was serving a sentence of 7 years in prison in the Penal Unit 19 of Saavedra and now he was lodged in the UP 4 of Bahia.

He did so after receiving a report from the social area of the Buenos Aires Penitentiary Service (SPB) that monitored compliance with the measure in a house in Punta Alta. In the report, the woman who lives with Ibars stated that she felt threatened by his presence there .

“She said that she was very exposed and that on more than one occasion stones and broken windows had been thrown from the house. I was afraid for her and her children, ” a source from the Bahia court revealed to Clarín . He added that the woman had also reported anonymous threats.

He also mentioned that the climate of repudiation generated by the departure of prisoners due to the pandemic aggravated the environment. “It is a situation that could not be ignored. To avoid a violent escalation and as a precaution, the decision was made to send Ibars, momentarily, to Villa Floresta Penal Unit 4, ”the spokesperson explained.

He will be there, isolated from the rest of the prison population , until Brun makes a final decision regarding his situation. Between Monday and Tuesday, it will hold hearings on this matter, with all parties. According to the source, the suspension of the benefit was informed and consented by the prosecution and the defense.

He also dissociated her from the alleged request for impeachment that would be brought against the judge. “It is not the first time that such an exceptional benefit has been suspended. It is a normal procedure that before any anomaly, is revoked. Ibars was still detained, he was not released, "added the source, without further comment.

Brun is the holder of the Criminal Execution Court No. 1 but he is also the head of the Court No. 2 of Bahia. He replaces Onildo Stemphelet, separated after a scandal by a robbery complaint in a place where a brothel would operate. Since the beginning of the quarantine, about 150 requests for house arrest came to both courts.

Just over half were resolved and some 30 were granted favorably. Fifty applications were rejected by Brun and are pending appeal. It turned out that, days ago, the magistrate requested that the appointment of a definitive replacement to the head of Court No. 2 be expedited, by virtue of the workload.

Ibars was sentenced on November 12, 2015 to 7 years in prison for the abuse of a young woman with a mature delay . The girl lived in a shelter home in Bahía Blanca and on the weekends her brother would look for her to take her home and to a house in Punta Alta, where she was sexually assaulted.

Ibars was living in this last address. The abuses took place there and in another house between February and August 2008. According to what the victim reported in Gesell Chamber, she was also abused by her brother. She said that sometimes he controlled the door to the room while being subdued by Ibars.

During this period, the young woman became pregnant and her family achieved a therapeutic abortion. DNA analysis determined that the affiliation did not belong to Ibars. His defense attorney requested acquittal. The prosecution had requested a 12-year sentence and the victim's attorney a 20-year sentence.

"I'm ashamed to look her in the face. How do I tell her this pig came out? " The victim's lawyer, Fernanda Petersen, had complained after the ruling in favor of Ibars, who has now been reversed.
