Wolfratshausen - The pleasure was short-lived. On Monday, Dr. Josef Hingerl opened the Bergkramerhof golf course in Wolfratshausen contrary to the order of the state government to play golf (we report). On Tuesday morning he had to close the place again.

Golf club in Wolfratshausen: owner has to close again

In the closure notice of the district office, which can be viewed on the website of the golf club, "the opening of the course up to and including May 10, 2020 is prohibited." In the event of an infringement, i.e. an earlier start of the golf business, a penalty of € 25,000 per day of opening will be threatened. Bergkramerhof GmbH has to bear the costs of the procedure, initially a fee of 400 euros for the notification sent.

District office threatens to pay a penalty

To the delight of all Bavarian golfers, Prime Minister Markus Söder announced on Tuesday afternoon that in the course of further easing, “contactless individual sports outdoors” would be allowed again from May 11th. With that, the matter could now have its end. But Josef Hingerl does not want to be satisfied with this; he is suing the decision of the district office at the Bavarian Administrative Court.

Wolfratshausen: Hingerl wants to hold on to the lawsuit

The lawyer explained that he was of the opinion that the closure of the golf courses was "unconstitutional from the first day" and that the individual decision against his place was illegal. Now he hoped for a judge's decision later this week, otherwise he would file a motion for a declaratory judgment. "The court should determine who acted unlawfully," demands Hingerl - not least because "in the end, it is also about compensation".
