Martinique: masks must be provided to prisoners in contact with outside workers

The Council of State on Thursday ordered the Minister of Justice and the head of the establishment of the penitentiary center of Ducos in Martinique to provide, as of May 11, a mask of protection to detainees called to meet with external stakeholders.

The high court had been seized of an appeal from the Minister of Justice asking him to annul an order of the administrative court of Martinique on April 5, which enjoined him, as well as the prison administration, to provide masks to prisoners at the Ducos prison center and to acquire sufficient screening tests to screen all those who have been in contact with a person showing symptoms of Covid-19 disease.

In its decision, the Council of State notes that as of May 11, “all external stakeholders (lawyers, prison counselors for integration and probation, external assessor of the disciplinary committee) will be forced to wear a non-health protective mask when they come into contact with detained persons ” , and that prison staff must also wear a mask.

"It appears that the detained persons will be the only ones not to have a protective mask during contacts with outside parties , " notes the Council of State, which considers it to be a "deficiency likely to justify that the Minister of Justice and the head of the establishment of the Ducos penitentiary center be ordered to supply, from 11 May, a non-health protective mask " to detainees who will have to meet with an outside worker .

The Council of State has also "reformed" the order of the administrative court concerning the obligation made to the Minister of Justice to provide a mask to all detainees and to have a sufficient number of tests, holding that it does not in both cases there was "no serious and manifestly unlawful interference with fundamental freedoms" .

He emphasizes in particular that measures have been taken by the head of the establishment "to limit contact with the outside and to reduce movement inside his establishment, instructions and measures actually taken to ensure the maintenance and cleaning of premises as well as compliance with health security rules ” .

Similarly, the prison administration is "in a position, with a screening capacity evaluated, in the territory of Martinique, at 460 tests per day over 6 days per week" , to apply government instructions aimed at detecting any symptomatic prisoner , estimates the Council of State.
