Is Alexander K. (35) a child molester? Or victim of a perfidious plot? The driver has been tried at the Munich regional court since Thursday.
Taufkirchen - The public prosecutor charged K. with sexual abuse. From 2016 to 2018, he is said to have abused his daughter Olivia (name changed), who is now ten years old, in Taufkirchen. A suspected crime that judge Sigrun Broßhardt is now trying to solve - but that will not be easy for the presiding judge. Because there is basically no evidence of the accused acts.
Defense lawyers doubt the daughter's testimony
The statement by the daughter is therefore crucial, but it is precisely this that the three defenders around the Munich sex criminal law expert Alexander Betz sharply attack. Yesterday, the lawyers objected to the gathering of evidence with several applications that, in her view, the investigating judge had made serious mistakes. For example, in the questioning of the girl: According to the defenders, little Olivia said there was no willingness to testify. According to the defenders, she was "literally tortured" in the survey. In addition, an educator apparently should have attended the survey. In the end the girl had pressed out the words "Daddy touched me". A clear case for the investigating judge: Alexander K. was arrested and has been in custody since February.
Was the child influenced by the ex-girlfriend?
The prosecution's indictment now reads that K. should have followed the same abuse trick three times between March 2016 and October 2018: Accordingly, he first sent his son to the bedroom, where he should play with the tablet computer. He himself stayed behind with Olivia, whom he was only allowed to see every other weekend after separating from his ex-girlfriend. Then he is said to have undressed himself and the girl and touched in the genital area. The third attack is said to have occurred in the ex-girlfriend's apartment in Taufkirchner. She will also have to testify in the process and currently has custody of Olivia. If one believes the family of the accused, Olivia was “massively influenced” by her to harm the accused.
The accused is silent
He does not want to comment on the allegations. "Our client defends himself in silence," says lawyer Alexander Betz. In his view, it remains open why the investigating judge stopped asking when Olivia made the allegations that burden her father so badly. Nine further negotiations are scheduled until mid-July.
