Hanover (dpa) - The Lower Saxony Higher Administrative Court has suspended the general quarantine requirement for people entering the country from abroad. The judges thus granted the urgent request of the owner of a holiday home property in Sweden.
The Senate temporarily suspended a paragraph of the Lower Saxony Ordinance on Infection Protection Measures against the Spread of the Corona Virus of May 8. As a matter of principle, he subjects those arriving from abroad to a quarantine obligation. The decision of May 11 is final, the judicial authority said.
One of the judges' arguments: The Infection Protection Act only allows regulation by ordinance if certain conditions are met. This law only provides for quarantine for certain people - such as the sick or suspected of being ill. With regard to the worldwide number of cases, which should be compared to the global population, even if a high number of unreported cases is taken into account, a foreigner arriving from abroad cannot be regarded as a general suspect of illness or contagion.
The freedom of people who are quarantined is significantly restricted. The judges argued that it was possible, however, to identify areas of risk by law that justified quarantine. Alternatively, the state could oblige people arriving from abroad to report immediately to the relevant infection control authorities. These could then take measures, for example through surveys and / or tests.
