State of health emergency: the Constitutional Council validates the extension but censures several elements

This is mixed news for the executive. This Monday, the Constitutional Council validated the law which extends the state of health emergency until July 10, but only partially. The sages decided to censor elements, notably linked to the tracing of potential patients and their isolation.

The Council, seized by the president Emmanuel Macron, the president of the Senate Gérard Larcher and other parliamentarians, "validates several" of the provisions of the law, adopted Saturday by the Parliament, he indicates in his decision published at the end of 'afternoon.

Limit the number of people accessing data

However, "concerning the processing of personal data of a medical nature for tracing purposes", it decided "two partial censures" to limit the number of people who can access this data.

It also decides so that a liberty judge can carry out a “control” if the patient cannot leave more than 12 hours from his place of isolation.

The other measures of deconfinement provided for in the text were able to enter into force on Monday morning, despite the examination by the Wise Men since, "taking into account these exceptional circumstances", a temporary decree was published in the Official Journal in order to apply them, with immediate effect. This is the end of the restrictions on leaving the home, obligation to wear a mask in public transport, reopening of shops provided that the barrier gestures and distance are respected, and that gatherings in public places are limited to 10 people. .

Initially, the executive hoped to be able to promulgate this law as early as Sunday evening, after the expected green light from the Elders, seized on Saturday by Emmanuel Macron, the President of the Senate Gérard Larcher and Sunday by 63 left-wing deputies. The Parliament had definitively adopted this law Saturday evening which extends the state of health emergency until July 10.
