An Isarwinkler was drunk with his e-medical elevator at the Tölz Christkindlmarkt and killed a woman. Now the man was on trial.

Bad Tölz - An Isarwinkler had caught far too many mulled wine with a shot when he visited the Tölz Christmas market. With around a tenth of a percent alcohol in his blood, a woman on her lap and howling loudly, the man drove down the market street in his electric wheelchair - and killed a passer-by. Now the district court in Wolfratshausen sentenced the trained construction worker to six months in prison. In addition, the 65-year-old was prohibited for six months from driving motor vehicles on public roads. This also applies to his electric wheelchair.

"The woman fell over alone," says the accused

The defendant, for whom 2019 was a tough year with three convictions within a very short time, denies the allegations. "I didn't kill the woman. She fell over alone, ”said the Isarwinkler, who had appeared in court on the stick. After all, he admitted that he had shouted "space free!" When he drove his medical elevator past the stands at a speed of up to 15 kilometers per hour. He had drunk at least three mulled wine with rum beforehand. "How do you feel there?" Asked the judge curiously. "No longer sober," said the accused. "How do you notice that?" The judge asked. "Because then you do such nonsense," the accused growled and asserted in the same breath: "I haven't been drinking for two months."

Victim wears bruises

The victim had clearer memories of the incident that occurred at 4:15 p.m. on December 13. You heard shouts, "Attention, away!" Said the Tölzerin (47). "Then it happened. He drove me in from the back with full force. “When falling, the woman contracted bruises on her thigh and hip. The wheelchair user had continued to drive, but the police quickly caught him.

If the blood sample was taken a little later, the suspect still had one per thousand alcohol in the blood. "He was no longer able to drive his hospital elevator," judge Helmut Berger stated matter-of-factly. He pronounced the Gaissacher "guilty of negligent risk to road traffic, negligent bodily harm and unauthorized removal from the scene of the accident" and sentenced him to six months imprisonment, which he however suspended.

No trips with the e-medical elevator for six months

In addition, the convicted person has to do without scooter rides for six months. At least on that point he got away cheaply: the prosecutor had applied for a 22-month ban.
