Bad Heilbrunn / Wolfratshausen – A Heilbrunner (48) has now been sentenced to an eight-month suspended sentence for negligent endangerment of road traffic and negligent intoxication. In May of last year he had caused a serious accident at Bichl and, among other things, put a pregnant woman at risk.
The accident could also have turned out worse: not much was missing, and the accused should have been tried before the lay judge in Wolfratshausen for negligent homicide. The 48-year-old raced into oncoming traffic with his VW Golf on Kreisstraße Töl 5, almost without brakes. He collided with the Peugeot of a dancer (31), who was then in the fifth month. Previously, he had rammed the rear of a BMW cooker (53) driving in front of him. The drivers suffered various bruises, the damage to their cars amounted to almost 50,000 euros.
Driver cannot remember accident
"I can only apologize and stress how sorry I am," said the accused in court. "I was hardly accountable that day." A blood test shortly after the accident showed that the man had consumed various intoxicants. He said that he suffered from depression as a result of his “long drug career”. On the day of the accident, he took diazepam, a strong sedative, "in very large quantities" and also drank three wheat beers. That is why he no longer knows about the accident. The memory only resumed in the intensive care unit in the Tölzer Hospital. He had broken his left ankle, sternum and various ribs in the accident.
The accused, who currently does not have a valid driver's license, stole his fiancé's car unnoticed that day. He had driven from Bad Heilbrunn via Langau towards Penzberg.
Shortly before the confluence with the 2063 state road, the BMW driver let her car roll out, as the witness described in court. "In the side mirror, I saw the car racing towards me, and then it already rattled." The cook suffered a concussion and a whiplash injury from the impact.
The Tölzerin, who was accelerating on the opposite lane after turning, testified that the oncoming Golf was traveling at very high speed. "I only saw him when it crashed," the woman explains in a halting voice. Nothing happened to the baby. "But until the all-clear, those were the worst hours." Four months later, she gave birth to a healthy girl.
Prosecutor wants to send man to prison
Because of the drug-alcohol cocktail, a significant impairment or even a loss of control ability at the time of the accident cannot be ruled out, explained one expert.
The accused had not been clear in another accident in March. Under the influence of medication and cannabis, he drove unchecked onto a novice's vehicle at a crossroads in Dietramszell. In 2015, the defendant was fined after a similar accident.
Now judge Helmut Berger sentenced the trained automotive mechatronics engineer to a prison term of eight months, which he suspended for three years. As a requirement, he gave the Heilbrunner a ban on alcohol and drugs as well as discussions at Caritas to draw up a treatment and therapy plan. The prosecutor's representative had applied for a five-month prison sentence without parole.
