Augsburg - Once again, a court in Bavaria has objected to a restriction by the state government to contain the corona pandemic . "You can imagine how the guests reacted when we had to tell them at 8:00 pm that they were no longer allowed to sit here," says Bernhard Spielberger, managing director of the Palladio restaurant . From now on, he can serve his around 90 outdoor seats until 10 p.m. "For my client, this is an economically important decision," says lawyer Bernhard Hannemann.

He had already submitted the urgent application before the state government decided to adjust the opening times for indoor and outdoor areas. However, this regulation will only apply from next Tuesday. Fabian Mehring, parliamentary managing director of the FW parliamentary group in the state parliament , is therefore calling for all restaurants to be able to cater for a longer period of time even at Pentecost. The FDP also advocates immediate alignment.
At the end of April, the Bavarian Administrative Court had already declared the sales ban for large businesses with more than 800 square meters to be unconstitutional. The state government reacted: shortly afterwards, large stores were allowed to reopen.
