District - Martin Beilhack (63), a farmer from Warngau, captain of the Waakirchner mountain archers and since the local election in 2020 also a district councilor of the Bavarian party, continues to fight against the suspicion of being a citizen of the Reich. Before the administrative court in Munich, he lost in a dispute against the Miesbach district office. The court rejected his complaint in the most recent written procedure. The plaintiff could not refute the impression that he had adopted the ideology of the Reich Citizens' Movement, the court said. Beilhack does not want to accept this assessment. He is now seeking an appeal through his lawyer.

"You lose faith in the rule of law"

Beilhack sees himself as a victim of a witch hunt. "You lose faith in the rule of law," he says bitterly. It all started in January 2017. At that time, representatives of the district office accompanied by the police ran up to the Beilhacks yard in Warngau and checked the hunter's weapon locker. The office suspected that the farmer could be part of the Reich Citizens' Movement.

The trigger was Beilhack's application for a so-called nationality card. In the opinion of the authority, he provided "typical citizens" information by referring to the - no longer applicable - Reich and Citizenship Act of 1913 and stating that he was a further nationality in addition to the German "Kingdom of Bavaria". The Reich Citizens' Movement is under the protection of the constitution, its members must not have weapons. With a decision dated May 26, 2017, the district office took Beilhacks gun licenses and gun ownership cards. There are two handguns and eleven long weapons registered.

Court confirms decision of district office

"I am not a citizen of the Reich and have never been," Beilhack assures. He himself made the action of the district office public in January 2017 and made serious allegations against the officials of the authority. He filed a lawsuit against the decision. The hearing was held in July 2019. There the court let it be known that the lawsuit will have little success, but has not yet passed a verdict. Beilhack, who also ran as a district administrator, prepared for a removal that was now taking place. The court confirmed the decision of the district office.

"The plaintiff was unable to dispel the suspicion that he was close to the Reich Citizens' Movement or its ideology - and possibly still close - when the decision was issued in May 2017," said court spokesman Martin Friedrich. This does not mean that the Beilhack court clearly classifies as a citizen of the Reich. But if it is not possible to clear up any suspicions, this is enough to revoke the weapons and hunting permits.

Martin Beilhack points to an oath of office

Beilhack himself cannot believe it. He had only recently sworn his allegiance to the Basic Law of the Federal Republic of Germany when he was sworn in as a district councilor. How could he be suspected of not recognizing the state as an imperial citizen? Beilhack asserts that he never let himself get into debt. There would be accusations on the hair to cut off his honor: "The district office makes belly swings that it freezes you."

A few days ago, he made an application for approval of the appeal through his lawyer. The Bavarian Administrative Court has to rule on this as the next instance.
