The Alliance pointed out that under the common law system pursued by Hong Kong, criminal law has no retrospective effect, and it is expected that the "Hong Kong version of the National Security Law" can follow this legal tradition. Secondly, the Alliance believes that Hong Kong should establish a sound enforcement mechanism by itself, and that the staff of Hong Kong agencies should be responsible for law enforcement, strengthen the confidence of Hong Kong people in "one country, two systems, and Hong Kong people ruling Hong Kong". They should not shirk their responsibility to the central government.

Third, the Union disagrees with the opinion that foreign judges cannot handle the "Hong Kong version of the National Security Law", and believes that foreign judges in Hong Kong have all sworn allegiance to the Hong Kong Special Administrative Region and the Basic Law, and excluding them will undermine the Basic Law. The principle of judicial independence guaranteed may even cause serious harm to the foundation of the rule of law in Hong Kong and the "Hong Kong version of the National Security Law".

Fourth, since Hong Kong’s legal system is based on the common law, the Alliance believes that the “Hong Kong version of the National Security Law” should use common law language to avoid future problems with the interpretation and application of the law, and it can better enable Hong Kong courts to When trying a case, you can refer to the judicial precedents of other areas where the common law applies in accordance with Article 84 of the Basic Law.

Finally, the Alliance believes that the "Hong Kong version of the National Security Law" cases should be handled by the Hong Kong courts, including the original trial, appeals court and final court, in accordance with the principles of fairness, impartiality and openness.
