A former electrician of China Overseas Construction Co., Ltd. received illegal commissions from two electricians for a total of more than 100,000 yuan, which enabled them to be hired by the company and was prosecuted by the Independent Commission Against Corruption. The defendant pleaded guilty to the charge at Tuen Mun Magistrates' Court today (22nd) and was sentenced to 9 months in prison. The magistrate ordered the defendant to return more than 103,000 yuan to China Overseas Construction, and rebuked the defendant for using his power to exploit the workers.

The defendant, Huang Jiahua (age 46), a former electrician in overseas Chinese construction, today pleaded guilty to 11 agents accepting interests, violating section 9(1)(a) of the Prevention of Bribery Regulations. Magistrate Shui Jiali ordered the defendant to return 103.45 million yuan to China Overseas Construction. The magistrate condemned the defendant for using his power to exploit workers.

The case revealed that at the time of the incident, China Overseas Construction's subsidiary was appointed by the Airport Authority to participate in an infrastructure project at the Hong Kong International Airport. The defendant was an electrician of China Overseas Construction, and was assigned to carry out electrical wiring works for the project.

The case alleges that due to a shortage of manpower, China Overseas Construction encouraged its electricians, including the defendant, to introduce other electricians to work on the site. The defendant introduced an electrician to join the job in April 2017, and told the other party that his daily salary will be 1,200 yuan, and he must give the defendant a rebate of 350 yuan per working day. The case revealed that the electrician reluctantly agreed to pay rebates because he did not want to lose his job opportunities. From May 8 to November 9, 2017, he paid the defendant a total of 61,950 yuan in rebates seven times.

The defendant re-introduced his uncle as an electrician on the site in July 2017. The defendant indicated to the other party that since he had no relevant work experience, his daily salary would be RMB 1,100. After the interview, the other party was finally hired with a daily salary of 1,200 yuan. The defendant later told his uncle that he could arrange for the other party to work on the floor to help him earn an additional 300 yuan daily salary, but the other party must give him 400 yuan rebate every working day. The case revealed that the uncle agreed to the defendant's request and paid a total of 41,500 rebates to the defendant four times between September 7 and December 9, 2017.

China Overseas Construction provided assistance during the ICAC investigation of the case. The prosecution was represented by ICAO staff Qiu Ziao today.
