Supervision of rents in Paris: many illegal advertisements, but only 75 appeals in one year

And yet… they swarm on classified ads sites! According to a study by Best Agents, published at the end of June, 53% of the advertisements posted do not a priori respect the framing. Despite this illegality assumed by many owners, sanctions are rare. At the risk of entering a vicious circle?

Only 75 remedies in a year. The Ile-de-France prefecture waited for the municipal elections to communicate. Since July 1, 2019, only 75 appeals have been registered (including 45 for a referral when the lease is renewed), reveals this Friday to Parisien the prefecture of Île-de-France. Of the 32 referrals concerning a new lease, "16 have already been the subject of a first formal notice from the lessor and the regularization, to date, of 8 leases", specifies the prefecture.

Why so few sanctions? While every month several thousand people move to Paris (where 2/3 of the population are renters), the number of sanctions can only seem extremely low. But the device pays there for a lack of communication and a process not well suited to the capital. It is the tenant who, once the lease has been signed, must denounce it to enforce the supervision… "The balance of power is such that few tenants take up the Conciliation Commission", deplores Ian Brossat, the deputy PCF in charge of Housing at the Paris City Hall.

Owners who profit. The framework of rents, as it is today, allows a landlord to exceed the ceilings by justifying an “additional rent”. But no grid today allows us to say if such and such equipment allows additional rent. Some landlords, as Le Parisien has already shown, take the opportunity to put everything and anything in it, such as the proximity of a metro station.

What effect? "Even if the lessors do not respect it, this system has at least succeeded in curbing the rise in rental prices in the capital," analyzes Thomas Lefebvre of Best Agents. "It has tended to contain the increase in rents, especially in the central districts, and to eliminate the big abuses", judge Alexis Alban, director of operations of Lodgis, specialized in furnished rentals in Paris. But despite a “slight” drop in rents over the six months following the entry into force of the framework, rents are starting to rise again. "This phenomenon can be explained by the few appeals filed," explains Meilleur Agents in his study.
