The death of Fabián Gutiérrez: What will happen now with his confession as repentant?

Cristina's former private secretary had provided information about the transfer of bags and spaces from the Kirchner house where they were kept.

On October 1, 2018, Judge Claudio Bonadio approved the collaboration agreement that made Fabián Gutiérrez a defendant collaborator in the cause of the bribery notebooks. He only did so after the former official expanded his confession and gave details of the role that each former secretary of Cristina Kirchner played in the president's inner circle. His testimony was corroborated by the magistrate, who processed him and sent him to oral trial together with the rest of the accused. What will happen to his sayings in an eventual oral instance.

The file where Cristina Kirchner is accused of having been the head of an illicit association that raised bribes among the contractor businessmen of the State, is based on the Federal Oral Court 7 (TOF 7), which will carry out the oral trial with more than 60 defendants.

The file of the investigation has more than 220 bodies, which include 231 measures, reports from AFIP, ANAC, RENAR, and other State agencies. That pack of documents is stored in 26 boxes. There is also  the confession of 31 accused collaborators , the largest number in a corruption case. One of them was the assassinated Fabián Gutiérrez.

The first part of the file was sent orally in September 2019. Days later -October 1-, the former private secretary of Néstor and Cristina Kirchner was accepted as repentant, and in December of the same year the section of the case that included his Testimony was also elevated to TOF 7 for trial.

Gutiérrez was a man of extreme confidence of the Kirchners. He participated in meetings, trips, roasts and political situations that surrounded former presidents from their beginnings in Santa Cruz to the summit of power in Buenos Aires. In May 2003, he arrived at the Casa Rosada with the brand new president, and was on December 9, 2015 in the last official act led by Cristina Kirchner. He had left his position as private secretary in 2010, but did not cut the relationship with the former presidential family, although it was much more sporadic.

In her long statement, Gutiérrez spared no words to describe what "working from sunrise to sunset" was like for Cristina Kirchner: she stated that "none of the secretaries" wanted to work with her. He spoke of "spaces in the house of Río Gallegos and El Calafate to store bags" , and said that at the moment when the mysterious packages arrived at these homes, Néstor Kirchner made them withdraw "and then we could enter" again, no longer the bags in sight. He spoke of "De Vido's hatred of Cristina" and of purchases for between $ 4,000 and $ 6,000 on the former President's official trips. All the data appear in Gutiérrez's statement before the Justice for the cause of the notebooks.

He ratified in his statement that there were trips that were made with bags jealously guarded by Daniel Muñoz - former private secretary of Néstor Kirchner. On these sayings, Judge Bonadio indicated that "they find sustenance in the testimony of the Air Force that gave an account of the way in which luggage was discarded on the presidential plane, while part of it was loaded without being controlled. "That he made trips to Río Gallegos and El Calafate and that the bags and suitcases with padlocks went to the Kirchner residences."

Gutiérrez also recounted, and was considered valid by Judge Bonadio, that in the El Calafate residence "there was a place going down the stairs where he had no access and could store the transported packages." Bonadio said that when he raided Cristina Kirchner's house he found said space.

Like the rest of the testimonies collected during the investigation, that of the former secretary would have to have been ratified during the oral trial. His death will prevent him. Does that change things? Sources of the cause denied it before  Clarín"The statement has already been taken and approved by the investigating judge, nothing is modified or altered."
