When the computer mechanic returned to his residence six years ago, he was stopped by a police officer who allegedly found methamphetamine in his trouser pocket. But he accused of malicious prosecution. The sports pants he wore that day had no pants pockets at all, and the drug trafficking crime he was accused of was eventually convicted. He claimed that he had been unjustly imprisoned for more than 400 days because of the case, and his then cohabiting girlfriend also left him. He filed a claim for about 3.4 million yuan from the government for this. The case was opened in the High Court today (6th).

The plaintiff is Lin Weiye and the defendant is the Secretary of Justice.

Accused of hiding 3 packs of methamphetamine

The plaintiff, who was not represented by a lawyer, stated in the opening statement that when he returned to Xiu Maoping’s residence on May 15, 2014, he was stopped by several police officers outside the residence and declared that three of them were seized in the plaintiff’s right front pocket. Pack ice, and find suspected drug use tools such as glass bottles, electronic scales and plastic bags in his room.

Girlfriend left Hong Kong after leaving crime

The plaintiff and his girlfriend were charged with one count of drug trafficking, but their girlfriend was taken out of custody two months later, and the plaintiff was found not guilty after trial. However, the plaintiff questioned that his sports trousers pockets did not have alleged trousers pockets. The police insisted that drugs were found in the plaintiff’s trouser pockets, which was completely unreasonable. The plaintiff claimed that after failing to return to his previous life, his girlfriend also left Hong Kong and never returned.

The defendant questioned that the pants pockets were not damaged

The plaintiff said during the cross-examination by the defendant that the sports pants involved were purchased at the bulk yard. Due to poor quality, the pants bag was pierced before the incident, and the pants were cut and stitched at the hour. The defendant questioned that his statement was different from the witness statement, and also pointed out that when the plaintiff was searched, his trousers pockets were not damaged and were "uncluttered." The plaintiff denied it.

The plaintiff also admitted that there were multiple conviction records between 1979 and 2008. He admitted to being a drug addict, but he was not addicted and still smokes marijuana.
