Will a single letter mistake lead to legal shaking in Israel? A ruling by the Grand Rabbinical Court drops the ground below tens of thousands of prenuptial agreements, all due to confusion between a marriage registrar and a marriage registrar.

According to Israeli law, a financial agreement can be signed in several ways - the first is through a court, but it requires a tedious legal process. The second is a notary and the third, the simplest of all, is to get a marriage record and sign the documents together with the marriage record for the wedding - catching two birds in one stroke. Therefore, many couples prefer to get married and sign the document which should facilitate the divorce process and prevent quarrels between the couple in the event of a future divorce.

However, over the years, an error has emerged stemming from two positions in the religious councils whose names are similar - a marriage registrar who is a local rabbinical clerk and a marriage registrar who is usually a mayor or other senior official who carries a legal power that allows him to sign financial agreements. Over the years, a system has taken root whereby the registrars, the junior officials, are the ones who sign financial agreements, when under the law only a marriage record can sign the document in question. According to the new ruling, if the marriage registrar is the one who signed the covenant agreement, in many cases it will not be valid.

The verdict was accepted after spouses recently divorced in a rabbinical court, after many years of marriage. The woman argued before the rabbinical court that the covenant agreement was invalid and demanded large portions of the husband's property and, after her opinion, no appeal was received to the great rabbinical court. Attorneys Adon Dibon and Tzivit Dibon-Katzber of the Dean-Dibbon office, who represented the husband, say that in their specific case, the Grand Rabbinical Court held that because the couple had acted throughout their 25-year marriage under the covenant agreement, it was valid, so the wife's appeal was denied, However, it is not at all clear that this is the case in thousands of other files.

"Thousands of agreements have been approved by invalid invalid registrars, it's an earthquake"

"Many spouses come to the rabbinate register and ask the marriage registry to sign a 'on the way' financial agreement," explains attorney Adu Dibon. "In my estimation, there are tens of thousands of prenuptial agreements approved by those registrars over the years, and these are not valid. The law explicitly states that an agreement must be approved by marriage, so there is great doubt with the agreements valid. "Attorney Zefit Divon-Katzber adds," Apparently there has been a mistake for years. The rabbis thought they were allowed to sign the agreements, and today there are thousands who are convinced that everything Okay, but if their couple ends up going to court or court they will find themselves in a big problem. It's an earthquake. "

In the ruling, the judges were instructed to pass the decision to the Chief Rabbinate so that they would work to correct the procedure and conduct of the marriage registers. Law firm lawyers, for their part, warn the public that they should immediately check whether their marriage agreement is valid. "We recommend that people take the agreements out of the box and see who approved them. At the same time, you also behave in your standard life according to the finance agreements and do not wait for the explosion. Do not put the agreement in the drawer and behave in a way that can cost you a lot of money in the future."
