The defendant, Jiang Wuhan (65), was a senior branch manager of Wantong Insurance Asia Limited (Wantong), and was charged with one count of fraud, violating section 16A(1) of the Theft Regulations. Wantong is now known as Wantong Insurance International Co., Ltd. (Wantong Insurance).
The defendant worked as a senior branch manager at MassMutual at the time of the incident. The defendant and the offline insurance agent under his supervision were responsible for marketing the insurance products of MassMutual.
If an insurance product is sold jointly by two insurance agents, each agent handling the sale will receive a half sales commission. MassMutual will also distribute various related bonuses to insurance agents according to their target turnover.
The accused alleged that the defendant allegedly falsely stated to Metrohm USA from December 8th, 2008 to January 9th, 2009 that the policy insured by a policyholder was handled jointly by two offline insurance agents, and The intention to defraud and induce MassMutual to pay commissions and bonuses to the two for a total of more than 130,000 yuan for the policy, which resulted in the two insurance agents benefiting, or MassMut was disadvantaged.
