In this letter, revealed by the Chained Duck , Éliane Houlette declines the invitation to answer the questions of this General Inspectorate of Justice (IGJ) because she considers that " the competence " of the latter " does not extend to the assessment of judicial acts ”.

Inspection opened by Belloubet

The former Minister of Justice Nicole Belloubet ordered an inspection on July 1 to shed light on the polemic investigation of the PNF, which lasted nearly six years and tried to identify, in vain, the " mole " who could inform Nicolas Sarkozy that he was tapped. This inspection must, according to the press release issued at the time by Nicole Belloubet, " determine the extent and proportionality of the investigations carried out and the procedural framework of this investigation ".

In her letter, Éliane Houlette declares that she refuses to answer it: she considers that "to inspect an alleged dysfunction of the PNF during this preliminary investigation would have the consequence of leading (the IGJ) to replace the legislative power or regulatory or even judicial interpretation in the event of a legal vacuum ”, as is the case with the use of detailed telephone bills (“ fadettes ”) from lawyers. The investigators resorted to this practice in this case, which was criticized.

" In a climate of denigration and verbal violence against the PNF, I do not intend to participate in an inspection likely to lead, in one way or another, to the destabilization of a republican institution who has completely fulfilled the mission entrusted to her by the legislator, ”insists the one who completed her term at the head of the PNF at the end of June 2019, before Jean-François Bohnert succeeded her in the fall.

Revealed on June 25 by Le Point , these large-scale investigations sparked a stir among lawyers and in the political class, leading Nicole Belloubet to request this inspection, expected for September 15. Eric Dupond-Moretti was among the lawyers targeted by this investigation, and had announced a complaint. Having become a Keeper of the Seals, he withdrew his complaint and undertook to " make public " the conclusions of the IGJ.
