The prosecutor investigating the case of Jorge Ríos, the 70-year-old blacksmith who shot and killed one of the thieves who broke into his house in Quilmes, took into account to accuse the retiree of "aggravated homicide" four main points.

1- The results of the autopsy, by which it was established that Franco "Piolo" Moreyra (26) received two bullets.

2- The images of the security cameras, in which it is seen when Ríos walks to where the thief is and, according to the accusation, finishes him off at the scene.

3- The kidnapping of three pods served at the crime scene, on General Acha street, 60 meters from the pensioner's house.

4- The statement of an eyewitness, driver of a Fiat Uno who is seen in the images and escapes, who declared having heard three shots.

Judicial sources explained to Télam that, based on these and other elements of the file, it continues to analyze in detail how the facts investigated happened.

Meanwhile, this week the ballistic comparison of the three served pods kidnapped at the crime scene with the Bersa Thunder 9 mm pistol used by Ríos will begin in the Expert Advisory Office of the Attorney in Lomas de Zamora .

In addition, in the next few hours the request of the private defense is defined to remove the prosecutor of the case, Ariel Rivas, from the Functional Instruction Unit (UFI) 1 of Quilmes.

In the event that the attorney general of that Judicial Department, Marcelo Dragui, finally rejects that request, one of the retiree's lawyers, Marino Cid Aparicio, said that they do not rule out requesting the recusal to the Justice of Guarantees, although he clarified that they are more focused in "the central theme" which is the technical defense of Ríos.

The objective of this defense is to demonstrate that it was a "legitimate privileged defense" and not a "homicide aggravated by the use of a firearm", as the prosecution of prosecutor Rivas is entitled. This, according to Cid Aparicio, stipulates a minimum sentence of 10 years and 4 months in prison.

The judicial source consulted indicated that the main elements on which the accusation was based are the autopsy, the videos, the kidnapped pods and the statement of a bus driver who said he saw the final sequence of what happened between Ríos and the deceased criminal.

According to the preliminary autopsy report, "Piolo" died from two gunshot wounds, one in the chest and the other in the abdomen. In addition, he had a fractured ankle that was made when he dropped from the roof of Ríos' house.

The video cameras of the Municipality showed two sequences: one, when Moreyra slides off the ceiling and runs away, albeit limping due to an ankle fracture; and another, about 60 meters from the retiree's house, where he is seen next to the thief lying on the floor, at the site where he was finally found dead.

In that same place, the experts seized the pods served, while a bus driver driving a white Fiat Uno, with a black hood, which is also seen in the video images, also passed by in a matter of seconds twice in a matter of seconds.

This witness testified before the Rivas prosecutor that he saw an "elderly person" - presumably the blacksmith - kick a fallen young man and that he heard three shots - two in a row - and, finally, a third.

However, Ríos's defense maintains that the shots that killed Moreyra were not fired there, but inside the house , when the blacksmith fled the criminals.

As a result of what happened that morning on July 17 last, the retiree was immediately detained. After refusing to testify before the Rivas prosecutor, his defense requested extraordinary release for health problems and because at his age he is part of the risk group for the coronavirus pandemic.

Last Monday, a day after Ríos decomposed at the police station and had to be assisted in a hospital, the judge of Guarantees Martín Nolfi granted him house arrest, after which the retiree settled in the house of a relative.

For Cid Aparicio, after having detained him with these health problems, the prosecutor Rivas incurred " loss of objectivity, loss of legality and violation of national and international laws ", so he asked for his withdrawal.

In turn, the sons of the blacksmith decided to put their father's property for sale, located in Ayolas at 2700 Quilmes Oeste where the assault occurred, since they are tired of the acts of insecurity and, at the same time, of receiving threats for part of people allegedly close to Moreyra.

" I was not born to kill anyone, " said the retiree in his only statement to the press as soon as he was released on a moribund basis, while his home was left with police custody to avoid retaliation.

For its part, the Quilmes Police, whose dome was changed after the fact, arrested four accused of participating in the attempted robbery of Ríos: Christian Chara (23), Martín Ariel Salto (27), Daniel Ezequiel Córdoba (25) and Claudio "Peque" Dahmer (27).

And while the funeral procession that accompanied the remains of Moreyra passed through the front of the Quilmes club stadium, the blacksmith's neighbors carried out a saucepan in front of his house to defend his actions and demand greater security.

On the other hand, the repercussions of what happened with the retiree reached in the last hours the case of another violent death that occurred six years ago also in Quilmes and that had as a victim Adrián Novillo (16), since the father of this boy stated that the same gang that assaulted Ríos is the same gang that beat his son to death.
