Coincidentally, the Minister of Labor, Élisabeth Borne, gave a clear warning on Tuesday, in Les Échos , to the attention of companies that would use this form of employment in the coming months.

"There is no question of the recovery plan being carried out with posted workers, " she said. Concretely, the new directive will make it possible to combat unfair competition more effectively. From now on, an employee seconded to France by a foreign company will be remunerated in the same way as an employee employed by a company in France, with a similar task. "The principle of equal treatment is affirmed: for equal work, equal remuneration", underlines in this sense the Ministry of Labor in a press release.

Another measure to establish a form of equity: employers will now have to reimburse posted workers for professional expenses in terms of transport, meals or accommodation. A cost that aims to reduce the flow of foreign workers. Finally, the directive creates a secondment status of more than 12 months which will allow employees to benefit from all the rights applicable to national employees. In addition, with this new text, the decentralized services of the Ministry of Labor now have the possibility of prohibiting recourse to a new service provision to a company found in default of payment of an administrative fine in matters of secondment.
