Jorge Ríos, the 70-year-old pensioner who shot to death one of the thieves who broke into his house in Quilmes, was hospitalized due to hypertension and the wounds in his arms became infected. This was reported by one of his lawyers, Fernando Soto, who also assured that the prosecutor Ariel Rivas (UFI No. 1) "arranged not to renew his preventive detention", so he was released.

"Jorge is hospitalized. He has his wounds infected and a serious picture of high blood pressure," said the representative of his defense, along with Marino Cid Aparicio, on his Twitter account.

Likewise, he revealed: "While we were advising Jorge in the Court and the Prosecutor's Office, the Prosecutor decided not to renew the Preventive Prison. Jorge is at liberty !!"

Federico (35), one of his three children, told Clarín that "from 7 in the morning until after noon they tried to lower his fever and there was no case", so they decided to hospitalize him.

The incident occurred on the 17th of this month, shortly before 5, when five thieves entered for the third time in the same morning to rob the Ríos house, located Ayolas at 2700, in Quilmes Oeste.

The retiree was surprised in his sleep, beaten and intimidated with a screwdriver by the assailants, so he took out a 9-millimeter Bersa Thunder pistol and fired several shots at them, causing them to flee.

In the images of the security cameras it is seen that one of the thieves, later identified as Franco Moreyra (26), was left behind by the rest of the band because he was injured in an ankle and tried to flee limping until he fell around the corner from the corner.

In the same videos it is seen that Ríos came out of his house armed and hit "Piolo" Moreyra, and kicked him and apparently shot and killed him.

For this reason, Ríos is detained with house arrest as the alleged perpetrator of a homicide aggravated by the use of a firearm, a crime that provides for 10 to 25 years in prison.

Franco "Piolo" Moreyra (26) died when he was shot by a retiree whom he wanted to rob, in Quilmes.

For the case, the Police have already arrested the four alleged accomplices of Moreyra in the assault, identified as David Ezequiel Córdoba (25), Christian Chara (23), Martín Ariel Salto (27) and Claudio Dahmer (27).

The defense of the retiree requested the recusal of the prosecutor in charge of investigation, Ariel Rivas (UFI No. 1 of Quilmes), which now must be analyzed by the judge of Guarantees No. 2 of Quilmes, Martín Nolfi.

The request is based on the alleged "breach of the Inter-American Convention on the Protection of the Human Rights of Older Persons, the restriction of access and control of evidence, and the omission of specific criminal investigation actions."
