The acting attorney general, Eduardo Casal, opened an administrative summary for labor abuse, such as giving orders to screaming , disciplinary punishment, psychological pressure, workplace harassment or throwing the opinions to the ground, to the commercial prosecutor, Gabriela Boquín, who intervenes in the contest of Correo Argentino SA. It did so based on the opinion of the Evaluating Council of prosecutors that recommended opening it by 5 votes in favor and none against . Among the 5 members of that council was the prosecutor Alejandro Alagia, member of "Justicia Legítima".

The resolution recounts the complaints of at least seven employees - named during the administration of former Attorney Alejandra Gils Carbó - who denounce that Boquín yelled at them, pressured them and created a "hostile climate" to work. Several ended up on medical leave for work stress, dizziness or decompensation.

In the file, seven employees denounced the mistreatment at work - for reasons of privacy, this newspaper will not publish their names - as pressure on a colleague to retire early, " contradictory orders to make us feel inferior and vilify our work," among others. Boquín has held that position since 2015 that Gils Carbó became the Attorney General of the Nation and then resigned in late 2017.

A former employee of the Foundation for Research and Development of Legal Sciences - which Boquín shares with former Kirchner lawyer and current head of the General Justice Inspectorate, Ricardo Nissen - went to work in the prosecution and said he started to have problems when they dealt with "a case of high political content" that they did not identify. Then Boquín put obstacles in his work or even to move to another prosecution. Gils Carbó is now Nissen's advisor at the IGJ.

In his defense, Boquín denied the allegations and disclosed that the summary would be revenge for his actions in the case of the Macri family's Correo SA company. E "indicated that the measures produced after the first opinion of the Evaluating Council were excessively biased and that statements were taken from arbitrarily selected persons , trying to transform their statements into complaints, according to what was reported by the Personnel Office, that there There were no actions by personnel that would have manifested mistreatment on their part. "

However, employee testimonials speak for themselves. After another leave, he took out the computer and the password to the computer system and did not give him work. Had to go to a psychologist because he appeared "skin spots" and could not sleep nerves , "says the opinion according to sources consulted by Clarin .

Another said that "Dr. Boquín spoke ill of the other secretaries of the dependency, seeking a constant division of staff ."

Then she related an episode in which on the occasion of working with a boss, "the prosecutor Boquín shouted out of her office and addressed him in a very bad way. In conclusion of what happened, she said that" to X (NdR he omit the name)  psychologically liquidated it . ""

The employee maintained that "the prosecutor used the formation of internal files against personnel as a persecutory method and that many times they started them due to mere material errors."

On the other hand, another employee spoke of "a relevant cause, in which the prosecutor issued an opinion that reached the media. Faced with this, she said that she proposed, in order to achieve her transfer of dependency, that Denounce the Office of the Attorney General of the Nation —particularly the Secretariat of Administration and Human Resources— for pursuing persecution for reasons of political ideology against it . " In this context, Boquín "suggested that he formalize a complaint against Dr. Eduardo Casal and Juan Pablo Ugarte , which he refused , according to his sayings" for not sympathizing with reality and because Dr. Ugarte had given him the possible a solution that Boquín refused ”".

In the conclusive part, the Evaluating Council said that "the files incorporated and what was stated by Dr. Gabriela Boquín, unanimously concluded that it was appropriate to initiate an administrative summary that includes all the facts mentioned in the indicated file and those that arise in the investigation, they can set up a pattern of workplace abuse . "

For the Evaluating Council, it was added, "the events denounced by the officials account for behaviors typical of the types of mistreatment and labor mobbing ."

In this sense, they mentioned attitudes attributed to Boquín "consisting of isolations; lack of precise direction; punishments with depreciation of functions ; cut off of vertical communication; yelling at subordinates; reprimands; excessive and / or absurd prohibitions (answering the phone, going to the bathroom, meet with other people, leave the office where you are working, even if it is to obtain information stored in a computer and necessary to carry it out); denigration for errors or supposed errors; formal prosecutions through files ; explicit threats of lobbying based on people's data ( "knowing how to put together folders" ); threats to throw personal belongings ", among others.

Also noted, the members of the Evaluating Council, the "numerous officials and employees left the prosecution and several reported having suffered from health problems " and did not present their testimony.

The opening of the summary was in the framework of a file initiated from a complaint made before the Office of the Attorney General of the Nation, and presented by an agent who served as a senior officer in the Attorney General's Office before the National Court of Appeals in the commercial by Boquín, which then totaled six .

"After analyzing the statements of the agents whose testimony was collected and the different files that were incorporated, compared to the explanations provided and the evidence provided by Attorney General Gabriela Boquín, I consider, according to the opinion that unanimously issued the Evaluation Council , to whose content I refer for reasons of brevity, that an administrative summary must be initiated, "Casal said.

The purpose of the summary "should be aimed at establishing whether the reported events occurred? In the manner in which they were described and eventually if others of the same tenor occurred whose occurrence could arise from the evidence that is produced and, if appropriate, determine whether they are relevant to set up a disciplinary charge, "said Casal.

In this framework, the acting attorney general stressed that "the instructor should pay special attention to the performance of the attorney general in order to make a distinction between those personality traits in her role as head of an office that may obey a severe character, of situations that could be framed in a misconduct or mistreatment of personnel ".

Finally, Casal appointed the magistrate of the Public Prosecutor's Office Fabián Roberto Enrique Celiz to act as investigator of the summary and entrusted him to produce the final report within a period not exceeding sixty (60) days.
