The Housing Department said today (4th) that a public housing resident living in Lok Fu Village declared that he did not own a Hong Kong residential property when he filled out an income and asset declaration form. However, after investigation by the Housing Department, it was revealed that he did not indicate that he owned a residential property in Baguio Bay, Pokfulam, and was therefore not eligible for public rental housing. The tenant was found guilty in the Kowloon City Magistracy yesterday for violating the Housing Ordinance, and was immediately sentenced to two months' imprisonment with a suspended sentence of 12 months.

A spokesman for the Housing Department pointed out that a public housing resident living in Lok Fu Village declared that he did not own a Hong Kong residential property when he filled out the income and assets declaration form in 2019. However, he owned a residential property in Baguio Bay, Pokfulam at the time of the incident, so he was not eligible for public rental housing.

The tenant violated section 27(a) of the Housing Ordinance and was prosecuted by the Housing Department for neglecting to provide the details specified in the income and asset declaration forms.

Found guilty

The defendant was found guilty in the Kowloon City Magistrates’ Courts yesterday afternoon. Considering the seriousness of the case, the magistrate immediately sentenced the defendant to two months’ imprisonment with a suspended sentence of 12 months.

Otherwise, residents may knowingly make false statements and violate section 26(1)(a) of the Housing Ordinance; or they may violate section 27(a) by neglecting to provide details specified in the asset declaration form, respectively. He was sentenced to a maximum fine of 50,000 yuan and imprisonment for 6 months, and a maximum fine of 25,000 yuan and imprisonment for 3 months.
