(CNN Spanish) - The Paraguayan Prosecutor's Office reported this Friday that it has not detected elements that prove that the former Brazilian footballer Ronaldinho Gaúcho had a direct participation in the planning and obtaining of irregular documents with which he and his brother Roberto entered the country March 4.

This exempts men from the responsibility of having control and decision on the use of documents, according to a conclusive requirement presented by four Paraguayan prosecutors to a criminal judge of guarantees.

If the judge accepts the proposal, the former star of the Brazil team and her brother will be released and will be able to return to Brazil.

The final decision is in the hands of Judge Gustavo Amarilla, who must study the request of the Prosecutor's Office.

On the other hand, the Public Ministry of Paraguay requested that Ronaldihno pay $ US 90,000 to repair the damage caused by the use of irregular documents to enter Paraguayan territory, establish domicile in Brazil and appear every three months for one year, before judicial authorities of Brazil.

According to the Paraguayan Prosecutor's Office, Ronaldihno Gaúcho and his brother Roberto left Brazil with Brazilian documents, but upon arriving at the Silvio Pettirossi International Airport in the city of Luque, Paraguay, on March 4, they presented false Paraguayan passports.

From the beginning, the defense of the Assis Moreira brothers maintained their innocence, arguing that the men did not know that they were false documents.

The Assis Moreira brothers initially served preventive detention in an Asunción prison, and since April 7 they have been in home confinement in a hotel in the Paraguayan capital.

According to Ronaldinho's defense, the former soccer player went to Paraguay to support a social assistance program for Paraguayan boys and girls with his image.
