Federal Judge Ariel Lijo decided to unfold one of the files related to the Ciccone case , which investigates the renegotiation of the Formosa debt with a consultancy that was corroborated was simulated, carried out by The Old Fund -signature of Alejandro Vandenbroele and owner some time after the printing-. Making room for a statement by the defense of Governor Gildo Insfrán, it resolved that the provincial authorities involved be investigated by the Formosan justice , while the magistrate will continue to be in charge of the charges against Amado Boudou, José María Núñez Carmona and Vandenbroele.
The case investigates the maneuver by which Amado Boudou, while he held the position of Minister of Economy of the Nation, and José María Núñez Carmona, his partner and personal friend (in double roles, one from the public sector and the other private, respectively ), through the firm The Old Fund, and its representative Alejandro Vandenbroele, "would have entered into a consulting contract, irregularly and in violation of provincial law 1,180, with the Trust Fund of the Province of Formosa (FON. FI.PRO), managed by Jorge Ubaldo Melchor ".
During the investigation it was determined that "advice was simulated for the restructuring of the public debt of Formosa , a debt that had already been negotiated and the agreement signed between the former Minister of Economy of the Nation, Carlos Fernández, and the Governor of the province of Formosa, Gildo Insfrán, more than two months before Amado Boudou assumed charge of said portfolio. The objective, as determined by Judge Lijo, was to complete the contract between The Old Fund and the FON.FI.PRO for the "Spurious collection of money belonging to public funds of the province of Formosa ."
Lijo had investigated Insfrán in November 2017, almost three years ago.
The file maintains that after taking office, Boudou, in his capacity as Minister of Economy, signed together with Insfrán, in his capacity as Governor of Formosa, an addendum to the agreement previously signed by Cristina Kirchner, through which "it was stipulated that The restructuring of the debt not only included the capital (as had been agreed) but also interest, increasing the value of the bond to be issued to the sum of 312,941,277.63 pesos, which allowed The Old Fund to collect 7,667. 161 pesos for an advice that he never gave ".
Both the Governor Insfrán and the then Minister of Economy of Formosa, Inés Lotto de Vecchietti, "intervened in various administrative acts of their powers aimed at making both the hiring of The Old Fund in the maneuver of simulated advice for the restructuring of the referred to public debt, such as the provision of funds from the province of Formosa through FON.FI.PRO (administered by Jorge Melchor), "said Lijo.
Thus, according to the investigation, those involved "obtained" an illegitimate economic benefit of 7,667,161 pesos, credited to a bank account of the firm The Old Fund. With part of that money, foreign currency was bought and it was withdrawn in cash twice over the counter. In addition, a bank transfer for 2,265,120 pesos was made to the company Estrategias de Imagen y Comunicación, belonging to Martín Cortés , who, later, as of November of that same year, was appointed president of the Bank of Formosa and obtained shares of that entity. "
When analyzing the jurisdiction of the court to investigate the officials of the province of Formosa, Judge Lijo indicated that the acts investigated involve Inés Lotto de Vecchitti and Jorge Melchor in the performance of their positions as local officials of the Province of Formosa "and it understood that the facts carried out under investigation "refer to the exercise of their positions during the validity of regular constitutional periods."
In that order, "the determination of the responsibility that could correspond to local public officials, for the eventual violation of provisions of provincial public law, is proper to the local jurisdiction, " the magistrate said in his resolution and explained that the Administration Law Financial Administration of Assets, Contracts and Control Systems of the Provincial Public Sector (Law 1,180 of Formosa) "which establishes the framework to which the contracting between The Old Fund and the FON.FI.PRO should conform, integrates the local regulatory plexus of the Province".
As noted, Lijo indicated, "this segment of the maneuver investigated in the proceedings exclusively involves the interests of the Province of Formosa ".
Meanwhile, Comodoro Py will continue to investigate Amado Boudou, Alejandro Vanderbroele and José María Núñez Carmona in this case.
