Green, musty algae instead of white sand: If, contrary to promised, the beach is heavily polluted during a beach holiday, package travelers can get some of the money back.
Frankfurt / Main (dpa / tmn) - The large-scale pollution of the beach and sea by algae can be a lack of travel. A subsequent reduction in the travel price is therefore justified, decided the Frankfurt am Main district court (Az .: 2-24 O 158/18).
The negotiated case concerned a package holiday in the Dominican Republic. The tour operator advertised on photos with a wide, white beach, and the five-star hotel was "right on the beach". In fact, both the sea and the beach were polluted by algae throughout the holiday. Bathing and other sporting activities were not possible.
The court awarded the holidaymakers a price reduction of 20 percent. The organizer is not necessarily responsible for the area outside the hotel. In this case, however, he specifically advertised the nature of the beach.
