But it's also clear: Apfeldorf is not Kitzbühel or Tegernsee. There are only a handful of cases in the municipality for which the fee for the second home has been levied since 2005. And besides, one is tolerant on the Lech: "If a student now also lives here on weekends and during the holidays, that's not an issue, nobody has to be afraid," says Schmid.

Nevertheless, the topic has its place on the agenda, because: Due to a ruling by the Federal Constitutional Court, the second home tax statute has been declared null and void by two Bavarian municipalities. Because they used the gross annual rent as the basis for the calculation. Not admissible, the court found. And the Apfeldorf town hall had calculated the same since 2005.

Now the general question came up: waive the second home tax in the future or recalculate it? The consensus was quickly clear: we will keep it, only the fee will be calculated on the basis of the net rent in future. If an apartment owner fails to provide evidence of this, the municipality estimates this value.

But as mentioned at the beginning: It is about meager income: a total of between 700 and 2000 euros were collected each year, in 2019 the tax revenue was only 757 euros.
