The owner of a property in Fischbachau has to provide proof of two parking spaces in order to fulfill the building permit. Now he has proposed a solution - on lease.

Fischbachau - They are shown in the plan, but are missing in reality. The owner of a property on Kreitner Weg in the Fischbachau district of Birkenstein must provide evidence of two parking spaces in order to comply with the requirements of the building permit for his apartments that have already been built. However, a shed is currently blocking the parking area, explained Fischbachau's mayor Johannes Lohwasser (FWG) in the local council. In order not to have to tear it down, the builder proposed an exchange deal to the community.

According to Lohwasser, the content is as follows: The owner builds the two parking spaces on the community-owned property that has already been leased to him a few meters further in the direction of Birkensteinstrasse and provides the community with a strip of around ten square meters directly on Kreitner Weg. On the grounds that more street width is available for public transport.

The administration could not quite understand this alleged advantage. At the height of the property, Kreitner Weg is 2.90 meters wide, but further up it is only 2.40 meters wide. "So the additional space wouldn't help us much," explained Lohwasser. In general, he thinks it is difficult to meet the requirements of the municipal parking regulations on public land. Especially since the property owner knew that he had to prove the two parking spaces. "That was a prerequisite for the approval of the building application."

Josef Obermaier (CSU) saw it a little differently. He warned against rushing to abandon the proposal. “With that we cut our own flesh. Because of its curve, Kreitner Weg is already too narrow for garbage disposal to pass the property in question. "She's already driving a tire over private property," reported Obermaier. If the owner were to prove the two parking spaces here as prescribed, they would extend to the road border. "Then no more truck drives through there," said Obermaier.

Yes, replied building authority manager Werner Wagner. The owner has already demarcated his property with warning beacons and a traffic tape, but the trucks would still get past it. "So it works," said Wagner.

The other councilors were mainly concerned about a precedent. “If we enable building rights here with lease land, we will open the door,” warned Bernhard Padeller (FaB). Simon Irger (FWG) also saw the proposed exchange as a violation of the building regulations. "You can't just prove private parking spaces in public space."

In the end, the committee finally agreed on an on-site meeting against five votes. The decision was thus postponed. "Then we can get an idea of it for ourselves," said Martin Bacher (FWG). And pointed out that the narrow street width was no reason to make an exception here. Because: "Unfortunately we have to struggle with narrow streets everywhere in the community."
