Bad Tölz - There was another sensational mishap in the Federal Ministry of Transport: The new catalog of fines that came into force at the end of April had to be withdrawn a few weeks ago due to a formal error. A number of motorists in the district could also breathe through: They are now getting their driver's license back, which they had just revoked. Meanwhile, the traffic supervisors of the Bad Tölz-based Zweckverband Kommunales Dienstzentrum Oberland (KDZ) had considerable stress: They had to process thousands of new notifications.

The temporarily applied catalog of fines was characterized by a significant tightening of the rules. Many violations became more expensive. And the driver's license has already been withdrawn if you drove 21 kilometers per hour in town or 26 kilometers per hour outside of town. Previously, the limits for violations were 31 to 41 km / h, as Sebastian John, internal service manager of the association, explains.

The number of driving license withdrawals has multiplied

As a result, the number of driver license withdrawals in the KDZ's area of ​​responsibility "multiplied", as John says. Instead of the usual 100, the KDZ, whose catchment area extends over ten districts in a wide ring south of Munich, imposed 800 driving bans from the end of April to the beginning of July.

According to John, there were 61,000 proceedings at the KDZ during the temporary period of validity of the new catalog of fines. They were then dealt with in different ways: procedures that had already been concluded retained their validity. This is the case with smaller warning fines as soon as the offender has paid. And in fine proceedings when the two-week objection period has passed. “A large part of the proceedings did not have to be reversed,” says John.

Traffic offenders only have to pay 35 instead of 55 euros to park on the escape route

It was different with the ongoing proceedings - according to the head of the office, still around 15,000 to 16,000. "We are no longer allowed to pursue these proceedings," explains John. This means that in each individual case the offense had to be reassessed according to the old catalog of fines. The employees then sent corrected notices to all those affected. For the individual, this means, for example, that for a slight speed violation of six km / h in town, he does not have to pay 30, but only 15 euros - or not 55 but 35 euros for parking on an emergency route.

The withdrawal of the more stringent catalog of fines is particularly significant for those who have had their driving licenses withdrawn. For the most part, you can expect to get your driving license back. Where the proceedings are still ongoing, the Zweckverband also issues corrected notices - whereby the assessment of the offenses according to the old rules usually shows that the driver's license is not withdrawn.

Interior Minister gives up driving license revocation on the mercy path

Drivers license withdrawals that are already legally binding will be forwarded to the Ministry of the Interior. "These driving bans are being lifted by grace by the Home Secretary," says John. In total, around 700 out of 800 people affected can avoid having to surrender their driving license. Only for the 100 drivers who would have had to surrender their driving license under the old rules will it stay that way.

For the employees, correcting the notifications still means “significant extra work”, says John. In addition: After the ineffectiveness of the new catalog of fines became known, many motorists asked the association about the effects. "We got around 1,000 written or telephone inquiries," says John. The KDZ employees would not have gotten into trouble: "Most of them know that the mistake was not our fault."

In 2019, the Tölzer Zweckverband levied a total of 4.5 million euros in fines.
