They usurped and robbed a Kirchner house in Río Gallegos: Máximo asks Justice to take charge

One of the 26 properties that make up the Condominium of Máximo and Florencia Kirchner was placed at the disposal of the vice president's son, after a specific request from his defense, in April of this year. But the property, which is under judicial intervention in a money laundering case, became the subject of an unexpected dispute with the auditor Raquel Moyano. What is the controversy? The house had been usurped, then it was stolen and the head of the block of deputies K asks that the Justice take charge of this deterioration.

Formally, the Federal Oral Court 5 (TOF 5) did not give the management of the house to the Kirchners, but only the permission for its use with some requirements. As a result of the marked deterioration left by the last tenant, TOF 5 had ordered the controller to carry out the necessary repairs. The pandemic prevented jobs and in recent weeks, "a forced entry into the property was recorded . " Máximo's defense denounced the intervener for not having taken care of the house.

The property is located in Río Gallegos, capital of Santa Cruz, on Calle 25 de Mayo. And it is among the 26 properties that made up the former president's succession at the time. When that process concluded, the Maximum Condominium and Florencia Kirchner were created . By then, the current Vice President of the Nation had given all her assets equally to her children.

In the framework of the legal cases, in June 2017, Raquel Moyano was appointed as intervener . Her handling of the Kirchners' properties led to claims on the part of the defense of the family. Some properties were never rented out again - such as the apartment that Cristóbal López used in Puerto Madero and units in Río Gallegos - and there are hotels that are still closed. Even the Casa Patagónica Los Sauces suffered a marked deterioration and the Justice authorized the family to carry out the corresponding repairs so that its value does not decrease.

Before the start of the quarantine due to the COVID19 pandemic, the lawyer Carlos Beraldi presented a letter on behalf of the national deputy, where he asked to recover the management of one of the properties for his ex-partner and children . It is a property that was for rent, but when they recovered their possession they also detected that it was very deteriorated.

Máximo Kirchner wants the property to be used by his former partner, Rocío García, and their son.

The inspector reported that the house shows a "deplorable state, a product of the incivility of the former tenant , bordering on the criminal." A total of 31 photos exposed the damage that the tenant made to that property.

It happened that this property had a formal tenant, but in reality it had been practically "usurped" . The rent was not paid and after a judicial claim the eviction order was obtained. 

Then, the intervention ordered the necessary repairs to be carried out, "in order to put the aforementioned property in condition" , but reported that the situation in Santa Cruz with the quarantine complicated all the repair tasks. 

In Río Gallegos they are again in Phase 1  of mandatory isolation, with strong restrictions due to the latest regrowth. In a letter, the auditor reported that she hired a new company, which had already carried out tasks in some of the Kirchner properties in El Calafate, but the quarantine generated new difficulties: "They informed us that when they arrived in Río Gallegos, they had to complete a period of mandatory isolation of 14 days, which is why, for the time being, the subscriber decided to suspend said works. "

Another problem was added: despite the house being bricked up, there was a forced entry that was reported at the police station in the capital of Santa Cruz and led to another legal case. This caused even more damage to the house.

Thus, Máximo's defense objected to accepting the property without the corresponding spare parts . In the written submission it was indicated that "it is not possible to accept the return of the property located on Calle 25 de Mayo in the dilapidated state in which it is found."

In substantiating this measure, Beraldi charged against the intervener and said that more than three years ago, "Máximo and Florencia Kirchner were stripped of all the properties of which they are owners" -among them, the aforementioned property- and that "the property mentioned was intruded, no rents were charged for its use and it was vandalized by its occupant / s ".

Finally, it was required in the same letter that "the property be repaired as soon as possible and then be restored to its legitimate owners in the corresponding state", and Beraldi indicated that in the face of "the serious damages incurred, from now on we expressly reserve initiate the pertinent legal actions ". It will not be the first time that they denounce Moyano, who has already been intimidated by the court to "proceed -with a very urgent nature- to condition the house located on Calle 25 de Mayo in the city of Río Gallegos, in order to proceed to its prompt restitution ".
