Instead, the buyers, a Geretsried couple, recently had to answer for fraud in a particularly serious case involving usury before the lay judge at the Wolfratshausen district court.

The public prosecutor's office accuses the couple of having taken advantage of the pensioner's poor state of health (67) and his "obviously limited ability to make judgments" when the purchase contract was concluded in December 2016. Because of the onset of dementia, a cranial brain trauma and an alcohol problem, the 67-year-old “could no longer grasp everything”, the indictment said. It also shows that the man sold his house for 300,000 euros and received a lifelong right to live in the property's garden shed. The real value of the house is more than twice as much - 647,000 euros.

The matter became known after a lawyer who had already worked as a caretaker for the Geretsrieder a few years ago received a call from a BKA official in July 2017. It was about an "ominous transfer: 200,000 euros should be shipped to Switzerland", reported the lawyer as a witness in court. The transfer could be stopped. The lawyer was again appointed as a supervisor. A tenant drew his attention to the purchase contract, which had meanwhile been declared invalid. "The process was like being in a crime thriller," reported the lawyer from the purchase process, in which apparently a financial broker, who had meanwhile gone abroad, acted as the mastermind. “They tried to make money. The couple were probably just puppets ”, so the assessment of the witness. Further details were not discussed in the negotiation.

In a legal meeting, it was agreed that the proceedings would be discontinued if the couple pays the pensioner another 270,000 euros within six months. In addition, he continues to receive rental income from an apartment in the house. "The two of them shouldn't be punished, they're good to me," emphasized the senior, who still wants the couple to get their house.
