That and a complaint by the doctor for continued employment in the Bruck hospital were heard yesterday in the Munich labor court. The judge did not come to a conclusion after an hour and a half and adjourned the hearing. The final decision in the Permanetter case will be made on Monday.

"In addition to the public prosecutor's investigation, there were a few other problems," explains District Administrator Thomas Karmasin. The sum of many small things would only have allowed a termination as a solution. "We have made Professor Permanetter an offer that he can continue to work with us as an attending doctor," reports clinic attorney Stefan Griebeling. But the doctor refused. Probably also because the cardiologist fears having to wait too long for approval as a resident doctor, Permanetters lawyer Johannes Späth lets through. He is therefore fighting to keep his client in employment and has also sued against the dismissal: "We want to solve the problem in an unspectacular way." Späth accuses the clinic of failing to inform Permanetter quickly and in detail enough about the allegations made against him. In addition, a longer break from work is bad for the specialist's skills.

Bauer sees only one solution for the clinic: he becomes a permanent doctor or he leaves. Continuing to work as the chief physician of cardiology is impossible, otherwise one would become untrustworthy, adds Griebeling. You can't take leave and quit and then take everything back.

Forgery of documents must be clarified

The clinic attorney emphasizes that the dismissal cannot only be based on the accusations of negligent homicide: "What is particularly on my stomach is the accusation of inciting false notarization in office." Such a thing cannot be tolerated, especially in a managerial position.

"I think my patients need me," said Permanetter before the labor court. Bauer, on the other hand, immediately made it clear that the patients would receive good professional care despite the suspension. Although he also sees a loss in the termination, he must protect the interests of the clinic. If Permanetter remained as an attending doctor, that would be a reasonable middle ground. Reason: An attending doctor takes responsibility for his patients himself. At the moment it is still on the side of the clinic, explains Bauer, explaining the legal situation.
