The Guarantee Judge
Brenda Madrid on
Tuesday rejected the request of Pablo Moyano's defense to annul the call for investigation next Thursday in the so-called Independent case, where the vice president of the club is accused of
alleged fraud.
Daniel Llermanos
, lawyer for the Truckers' referent, had presented his request before the court of guarantees 9 of Lomas de Zamora, against the decision of the deputy attorney general
Sebastián Scalera
, who summoned Moyano to an investigation.
The lawyer argued that another prosecutor's office, the UFI 3 of Avellaneda, is competent in the case and that Scalera was displaced from the investigation, for which he could not have cited Moyano as a defendant.
However, the judge rejected this argument.
“Beyond the untidiness displayed by the Chamber Prosecutor's Office in this case, insofar as the intervention prosecutor's offices have been designated and changed repeatedly, it will
not correspond to make room for the suspension
of the hearing, since the recently appointed Prosecutor General has arranged for Dr. Sebastián Scalera to continue in the investigation ”, explained Madrid.
In this way, Pablo Moyano must appear on Thursday at 11 for his investigation.
The file investigates an illicit association with fraud against the Independiente club.
In December, Judge Brenda Madrid closed the investigation and sent
Pablo "Bebote" Álvarez
to an oral trial
as head of the illegal association, along with Damián Lagaronne, Roberto (Polaco) Petrov, Noray Nakis and Hector “Yoyo” Maldonado among others.
The vice president of the club is accused of having directed the
illicit association
together with Álvarez, but since he was later incorporated into the investigation, he is not included in this section of the case that the magistrate has already raised to oral proceedings.
The accusation claims that "from an undetermined date and at least until the month of November 2017, an illicit association made up of a variable and undetermined group of male and female persons, all of legal age, was operating, one being part of it. faction of the fans of the Independiente club ".
This claim was supported by the Lomas de Zamora Criminal Chamber, by rejecting claims by Noray Nakis and Héctor "Yoyo" Maldonado, also involved in the case.
This group of people led by "Bebote" Álvarez -who according to his confession as repentant in turn responded to orders from Pablo Moyano- "used to meet regularly on the grounds of football matches where the team intervenes in the vicinity of their stadium, in addition to their social headquarters and places where the matches are held, as well as in the places where Independiente's first division team concentrates prior to the matches and in the training venues ".
Among other aspects, the accusation highlights that the fraud against Independiente "through the management, obtaining, hidden printing and reselling of tickets, 'protocols' of access to the sporting events of said institution, bonds and social contributions outside the corporate sphere and without entering the economic product to the patrimony of the Club ”.
