The Tel Aviv Regional Labor Court issued an order tonight (Friday) prohibiting employees of the laboratories of Clalit Health Services from striking.
However, the court ruled that the rest of the lab workers could continue to strike, except for water and food quality monitoring.
This is after five days of strike.
In doing so, the tribunal partially accepted the position of the state and the position of Clalit Health Services itself, which was also signed on the application for orders.
Judge Ariela Gilzer-Katz criticized the state, ruling that "the Histadrut sought to negotiate with the state, but we were under the impression that the state did not seek to conduct intensive, genuine negotiations aimed at reaching an agreement."
She added that "the Histadrut declared a lawful labor dispute about two years ago, which concerned the State Comptroller's report and the Ministry of Health's report, which addressed the dissatisfaction of laboratory workers with wage conditions."
The judge ruled that "this is an economic, legitimate strike, declared lawful and in good faith," arguing that the Histadrut was responsible in declaring the strike, noting that it had agreed to exclude corona tests from workers' services.
She even reprimanded state representatives for presenting a misleading picture to the court on high-wage issues among some of the lab workers.

However, "although this is a legal and legitimate strike, we believe that there is room to reduce the scope of the strike for reasons of proportionality and balance of convenience, in view of the damages that may be caused to the public due to the strike," Gilzer-Katz stated.
It stated that laboratory workers would return to perform water and food quality monitoring, "in order to maintain public peace."
In addition, she noted that "with respect to Clalit - we have not found any justification for the strike of the laboratories it operates in hospitals and the community, while Clalit's hands are tied, and it cannot negotiate, and when it has no effect on ending the strike."
The tribunal concluded with a repeated recommendation to the parties to negotiate in order to bring an end to the strike.

The strike of laboratory workers began earlier this week, after the Ministry of Finance did not appear for negotiations on the workers' terms of employment.
The crisis in the laboratories is a result of the corona crisis, following which the working hours of the workers were extended, and on the other hand their terms of employment were not improved.
As part of the strike, about 2,000 workers in about 400 public laboratories provide emergency services only in laboratories that serve the hospitals in the public health system.
The laboratories in the community clinics do not operate on a first-come, first-served basis, and the tests that continue to operate as an orderly are life-saving tests from emergency and trauma rooms, intensive care, operating rooms (emergency only) and delivery rooms.
Also - tests for oncology patients and hematooncologists will work as usual.
In contrast, community testing services, which include hospital clinics and ambulatory surgery tests, will not be provided.
At the present time, they said, corona tests would be carried out and updates would be sent only on positive answers "in order to interrupt the chain of infection".
