The Juntos por el Cambio interblock prepares

an amparo

to present in the first days of the week before the courts in Federal Administrative Litigation, challenging the controversial session of the Chamber of Deputies last Tuesday unless there is a final political agreement before moment.

The presentation project was being analyzed this weekend by the legislators and lawyers

Gustavo Menna (UCR), Pablo Tonelli (Pro) and Mariana Stilman (Civic Coalition)

to later put it to the consideration of the authorities of the interblock chaired by Mario Negri.

Parliamentary sources announced that they will request that the final wording and presentation be carried out by two renowned constitutionalists.

And that his greatest concern is that the ruling party continues to advance with the judicial reform, which already has half approval from the Senate.

The deputy of Together for the Change of Córdoba, Soher El Sukaría, said this Saturday that “the decision to

go to justice is firm

.

Our advisors are finishing preparing the court presentation.

That there is no discussion ”.

“We want to meet in person, we understand the situations of deputies who cannot travel, and we are willing to hold mixed sessions.

The issue is to agree on

how this parliamentary agenda is going to take place

”, he added.

He warned that "10 days ago the Senate approved the judicial reform practically without the participation of the opposition and this is very serious."

The main judicial axes of the amparo will challenge

the way in which the virtual operating protocol was extended

and the session itself last Tuesday that Elisa Carrió described as an "act of force" by the president of the chamber Sergio Massa.

A source explained that the protocol that was signed when the coronavirus quarantine began says that it was accepted to hold virtual sessions

"by consensus"

of all blocks and that it had to be renewed every 30 business days.

The last extension had expired on August 7.

The other axis will be on the fact, worthy of the magical realism of the Nobel Prize in Literature Gabriel García Márquez, that "there were

90 deputies present but absent

" according to the chamber authorities who refused to take the roll.

"Therefore, the session in which projects related to tourism and fishing were voted did not have a quorum," they said.

In the draft amparo, he will cite as

antecedent a resolution of room IV of the Federal Administrative Litigation Chamber

, made up of Marcelo Duffi, Jorge Morán and Rogelio Vincenti, who established

that the protocol for virtual operation

is "expired"

.

He did so by rejecting as unofficial an injunction from Deputy Mónica Frade, who demanded that there be face-to-face sessions.

But this time, the presentation will not go by the contents, but by

"the violation of the processes".

The aim is to make a “technically well founded” presentation because, for example, the complaint that had been made when Daniel Scioli, appointed ambassador, was present and voted in the session that dealt with the privileged retirements ended up archived.

The Sukaría recalled that “since August 8, the political agreement by protocol had expired.

Sergio Massa already had enough time to build bridges and dialogue with all the opposition blocs and redirect how we continued working ”.

In statements to FM Milenium, El Sukaría revealed that on Tuesday "Massa was willing to agree on a way out of this crisis and it

was Máximo Kirchner, the president of the ruling party, who decided to go out and boycott the agreement

."

"It was a fact of institutional gravity and what we experienced on Tuesday is nothing more and nothing less than

what Venezuela has been experiencing for many years

, unfortunately there were two parliaments that were sitting in parallel," added the Cordovan legislator who on Tuesday, in her speech, questioned to Massa.

He said the opposition

wants certainty about the agenda of the lower house

.

“These days the budget enters, but the tax on large fortunes has already entered, the reform of the retirement base is about to enter to reform the calculation of pension assets, also a reform of the co-participation law that directly affects the provinces and also a reform to the taxable income base ”, he added.

He stressed that "we are talking about very important things plus the judicial reform that is already coming from the Senate with half a sanction" to deal with them virtually.
