Justice Minister Avi Nissenkorn may make decisions on Histadrut activities and collective disputes between Ministry of Justice employees and the Histadrut, despite alleged conflicts of interest between his current position and his previous position as head of the Histadrut. 

Deputy Attorney General Dina Zilber ruled that the Minister of Justice is not in a conflict of interest with the new Histadrut, even though he served as the organization's chairman until he joined politics.

This is despite a previous ruling forbidding former Minister Haim Katz from dealing with issues related to IAI - where he served as chairman of the workers' committee until his appointment as minister - for a longer period, of three years.

Zilber's decision regarding Nissenkorn was made as part of a recent Justice Department's conflict of interest opinion '.

The opinion stated that Nissenkorn was not prevented from dealing with issues related to the Histadrut, since his position as chairman of the organization "was done within the framework of your public role, not talking about issues in which you had a personal or private interest." 

This is a puzzling position in light of the fact that the Histadrut has not been a "job" for Nissenkorn, who has grown in the organization for 15 years intermittently, since 1995. For the past five years, Nissenkorn served as chairman of the Histadrut, a position he did not leave even after joining Ganz in February 2019. . 

Initially, Nissenkorn only announced a "vacation" from the Histadrut and appointed Arnon Bar-David as his successor - that is, Nissenkorn allegedly kept the possibility of returning to office at the end of the political adventure, thus expressing confidence in Bar-David to retain the chair and position him as the organization's next leader.

Following a petition to the High Court, Nissenkorn finally left the Histadrut, and Bar David became permanent chairman. 

Nissenkorn also stated in the conflict of interest document that he is "close" to Histadrut spokesman Adv. Yechiel Shemer, but this detail apparently did not change Zilber's position, which stated: "We do not believe that this is a close friendship to the extent that it justifies imposing restrictions on your occupation. In matters concerning Adv. Shamir "- unless Shamir places himself in a judicial position. 

The arrangement states that more than a year has passed since Nissenkorn left the Histadrut, and therefore this is a sufficient "cooling-off period" thanks to which he can engage with the Histadrut. 

The main issue that concerns the Histadrut and that Nissenkorn will need in the near future is the approval of the regulations of the Ottoman associations, which are intended to impose reporting and transparency obligations on them.

As of today, the Histadrut, by virtue of being an Ottoman association, is exempt from providing financial and other reports. 

The Ministry of Justice did not respond.
