Cannabis, cocaine, ecstasy, MDMA: a fine of varying geography in Ile-de-France

The standard fine for possession of narcotics, generalized to the whole country since September 1, does not target the same quantities


If the police check you with a few cannabis bars in your pocket, you could get a fine of 200 euros… or legal proceedings.

It all depends on the department where you are.

Because the fixed tort fine, which targets drug users below 50 grams of cannabis and 5 grams of cocaine, is not applied everywhere under the same conditions.

It is the prosecutors who set the thresholds.

And in Ile-de-France, they vary from single to double: no more than 20 grams in Meaux, and up to 50 grams for example in Seine-Saint-Denis or Essonne

Thresholds set according to "traffic intensity"

"The quantities are fixed in relation to the intensity of traffic in the department, and by opting for the ceiling of 50 grams of cannabis, we can penalize more users," said the Evry prosecutor's office, who gave his instructions on Monday.

In Essonne, users of cocaine, ecstasy or MDMA can also be fined as long as they do not have more than 5 grams.

This is also the case for the possession of less than one gram of cocaine in the Hauts-de-Seine, "only near places of shows, concerts, festive gatherings".

In Pontoise (Val-d'Oise), the fine will be implemented shortly.

In the meantime, it is always the reminder of the law that prevails in the event of detention below 20 grams, for first-time offenders.

Crack and heroin excluded from the system in Paris

Note that in Paris - where, according to our information, around forty consumers have been fined - heroin and crack users are not concerned, "given the objectives of the crack plan and the responses of the prosecution. , which notably provide for therapeutic injunctions and training courses to raise awareness of the dangers of narcotics ”.

The fine is not intended as a response to addiction.

Hauts-de-Seine (92):

up to 20 g of cannabis, 1 g of cocaine, only around places of shows, concerts, festive gatherings

Seine-Saint-Denis (93):

less than 50 g of cannabis

Essonne (91):

less than 50 g of cannabis, 5 g of cocaine and 5 g of MDMA and ecstasy

Val-de-Marne (94):

up to 30 g of cannabis.

Seine-et-Marne (77):

less than 20 g of cannabis
