Corona demo in Munich may not take place as planned - but the court decision has a surprise in store

Update from September 12, 2020, 9.38 a.m.:

The

Corona demo in Munich

may not take place as planned.

The

Bavarian Administrative

Court decided this

early on Saturday morning - and thus partially confirmed the first instance judgment and the city's requirements.

However, a previously forbidden elevator with up to 500 participants was allowed from

Odeonsplatz

to

Theresienwiese

.

Otherwise, the organizers' complaint was rejected.

The

demo

on the

Theresienwiese

can only take place with 1000 participants.

The

Süddeutsche Zeitung

reports, however, that the Bavarian Administrative Court (VGH) lifted the limitation of the meeting there to 1000 visitors.

According to a VGH spokeswoman, there is no fixed upper limit for the number of participants, not even 5000. From the court's point of view, the decisive factor is “that the hygiene regulations (can) be complied with.” The initiative

“lateral thinking 089”

, which organized the demo, had previously lodged an appeal against decisions of the Munich Administrative Court.

According to the company's own statements, there are no legal remedies against the decisions of the Bavarian Administrative Court.

Originally the

demonstration

with 5000 participants on the

Odeonsplatz was registered

under the motto "Peace, Freedom and Health".

The city banned the demo and only allowed it under strict conditions on the

Theresienwiese

- but only with 1000 participants for infection protection reasons.

A planned demonstration through the city was also prohibited.

The organizers had sued against this requirement.

The

Munich Administrative

Court then confirmed the city's decisions (M 13 E 20.4261 and M 13 E 20.4258).

One argument for this: the foreseeable violations of the legally mandatory distance requirement created an immediate danger to public safety, the judges said.

Lateral thinking demo against corona policy in Munich: court decision on urgent application has been made - with one restriction

September 11, 6:04 p.m

.: The Munich Administrative Court has confirmed the decisions of the City of Munich in a judgment.

This means that the Corona demo on Saturday may only take place under the conditions, i.e. with 1000 participants on the Theresienwiese and without a train through the old town.

The organizers of “lateral thinking 089” now have to go to the

Bavarian Administrative Court

.

Update from September 11, 12.26 p.m.:

As has now become known,

the

second urgent application from

the organizers of the

demo against the corona measures has also been

received

at the

Munich Administrative

Court

.

While the first application is directed against the ban on marching through the city with a demonstration march (see update from September 11, 11:23 a.m.), the

second urgent application

concerns the

limitation of the demonstration to 1000 participants

Lateral thinking demo against Corona measures in Munich: City held talks with the organizers

It was not

clear

for a long time

whether the offshoot of the

Stuttgart lateral thinking movement would take place

in the planned form.

The city first held talks with the organizer *, during which several locations were also to be discussed.

The authorities would also include the events of the rallies in Berlin on the last weekend in August in the

risk

forecast.

In Berlin, on the fringes of several demonstrations against the Corona * measures, clashes between demonstration participants and the police broke out.

In addition, dozens of people tried to use force to get into the

Reichstag building

.

The actions of the demonstrators had

caused outrage

among politicians across

Germany

.

In Germany everyone can say what they want.

But symbols of the right-wing extremists before the Reichstag are a throwback to the darkest chapters of our history.

The demonstration in Munich was originally supposed to

take place

Lateral thinking: Corona demo in Munich - crackdown by the police announced

The Bavarian state government has now

announced that

the police will crack down

on violations of the law

for the demonstration in Munich

.

In

Bavaria,

freedom of

demonstration

applies

, as Interior Minister

Joachim Herrmann made

clear on Tuesday (September 8).

However, anyone who does not adhere to the “current legal rules” must expect his meeting to be ended.

This applies, for example, to maintaining

minimum distances

, the minister added.

If these or other conditions are violated, the necessary preparations have been made so that "the rule of law can also speak up if necessary".

In any case, there would be "sufficient police forces" ready on Saturday in Munich.

The specifications for the rally are a matter for the

city of Munich

, but the police are involved.
