The Lod District Court today (Monday) sentenced Amiram Ben-Oliel to three life sentences, who was convicted in May 2020 of three murders as well as attempted murder and arson in the Duma terrorist attack case.

Judge Roch Loch said that Ben-Oliel "is guilty of serious acts he committed, which resulted in an unbearable result - the loss of the lives of members of one family and the severe injury of Ahmad. His actions stemmed from extremist ideology and racism. He wanted them dead but because they were Arabs."

The defense believed that the defendant should only be sentenced to life imprisonment.

The judge said that "it would be an immoral consequence in the circumstances of the case to see his action as one act for the purpose of sentencing."

At the sentencing hearing last June, the prosecution sought to sentence Ben-Oliel to three life sentences, 40 years in prison and a maximum compensation payment.

At the beginning of the hearing, the grandfather of the family, Hussein Dwabsha, said, "I have hope that he will do justice, even though it will not bring my family back. I wish this thing did not happen and we were not here today. I hope he will sit in jail all his life."

Ben Oliel was convicted of murdering the couple Saad and Riham Dwabsha and their toddler son Ali in 2015.

He was also convicted of two counts of attempted murder, two counts of arson and conspiracy to commit a racially motivated crime.

However, he wins from a clause attributing to him membership in terrorist offenses.

Advocate Yitzhak Bam, representing Ben-Oliel together with Adv. Asher Ohayon, have previously clarified that they will appeal to the Supreme Court on the conviction.

According to the indictment, Ben-Oliel and minor A. planned to carry out an attack following the murder of Malachi Rosenfeld in 2015 at the Shvut Rachel intersection.

The two observed Palestinian villages and decided to kill people in the Duma and then in a nearby village.

The two agreed to meet on the day of the attack in the cave in the Yishuv HaDat outpost.

Ben-Oliel prepared the equipment for the attack: two bottles filled with flammable liquid, rags, a lighter, a box of matches, gloves and black paint spray.

A., who was a minor at the time the crime was committed, was at the time with other young people in the Givat Habladim outpost.

Around midnight, A. left the place, but arrived at the cave after Ben Oliel had already left for the Duma.

When Ben Oliel reached the outskirts of the village, he covered his face and put on gloves and looked for a house that was not abandoned.

According to the indictment, Ben-Oliel first set fire to an empty house and then threw a Molotov cocktail through a window in the Dwabsha family home and fled.

Toddler Ali was killed on the spot, and the deaths of the couple Saad and Riham were later determined at the hospital.

The boy, Ahmad, who was four years old, managed to escape and was hospitalized in critical condition.

The two admitted to their interrogations in the act but retracted them.

In the petty trial in their case, the judges rejected Ben-Oliel's confessions, which were collected under physical pressure, as well as A.'s confessions, which were given during and after physical interrogations.

However, it has been determined that Ben-Oliel's other confessions and the restoration are admissible.

This coming Wednesday, the Lod District Court will sentence A., who was a minor at the time the acts were committed.
