What is behind the offensive against attorney Eduardo Casal and what does Cristina want this strategic position for?

In the justice that is coming - an accusatory system that until now only applies in Jujuy and Salta, but that will soon advance to the whole country - the button to

promote or stop legal cases

will be in the Attorney General's Office, where the head of all federal prosecutors in the country.

That is the position that Cristina Kirchner, in these hours, is obsessed with conquering with someone from her troop, but

for herself.

The vice president put her entire legal and political team close to work on a triad of judicial objectives: judicial reform (to create more positions that liquefy the current power of Comodoro Py), reform of the Court (through the study of a commission of "notables" led by his personal lawyer, Carlos Beraldi) and the displacement of the attorney general, Eduardo Casal, to place

someone very close to

that

key strategic position

.

It needs a Carlos Zannini -current head of the state attorneys-, but

in charge of the prosecutors,

who are the ones who will shortly lead the

entire process of a criminal investigation.

With the new system, whoever has his own soldier there could

handle the causes from the very beginning.

The current attorney Casal is a man with a long judicial career and a

fiscal attorney

before the Court

for 28 years.

He came to the top position after the resignation of the previous attorney, Alejandra Gils Carbó, who appointed him as his temporary natural successor according to the law - he was the oldest prosecutor before the Court - until the Senate appointed his replacement.

As this did not happen and the Senate chaired by Cristina still does not have a consensus to anoint a new candidate with the two-thirds that are needed, an offensive began to get Casal to leave office ...

the hard way.

If this happened - they calculate in Cristina's environment - the second of Casal (Laura Monti) would go with him and the third prosecutor in seniority would remain as natural successor: Víctor Abramovich, former director of CELS and one of the signatories of the requested one that gave rise to

Legitimate Justice.

Someone much more akin to Cristina's strategy until a new appointment is obtained.

The anger against Casal was on the rise since

Operation Puf

-when they linked prosecutor Carlos Stornelli with an espionage operation in the federal court of Dolores to try to overturn the cause of the notebooks that the ruling party calls

"photocopies"

- understanding that the prosecutor was "soft" with Stornelli, who took seven months to appear before the judge in Dolores who had summoned him.

In fact, Casal sanctioned Stornelli with a warning.

But the offensive intensified in the midst of the pandemic, when Cristina "urged" the Court to tell her if the virtual sessions of the Senate would be valid and Casal ruled that this was an attribution of Congress and that the Court did not have an opinion on the matter .

A technical issue that Cristina

read as a personal question.

But how to kick Casal out?

First you have to

accuse him of something.

Later, to get him to impeach him in Congress where two-thirds of both houses would be needed, a figure that for now is unattainable for the ruling party.

The other option is to

force an internal trial:

that the prosecution court that functions within the Procuratorate itself to prosecute prosecutors does a process with the attorney.

Is this possible?

The position of attorney is

outside the scope of that court, which is for his subordinates.

But harsh Kirchnerism maintains that Casal is a prosecutor fulfilling the functions of the attorney and not a legitimate attorney.

That is why he wants to force a political trial right there.

In the Attorney General's Office they understand that whoever fulfills the role of attorney, even if it is temporary, fully exercises his or her powers and responsibilities and, therefore, is also responsible for being tried as such.

You cannot be at the same time

attorney general

to exercise all the responsibilities of the position and

common prosecutor

to be prosecuted by an internal court, they reason from that side.

The internal court has 7 members and hard Kirchnerism was represented by two, against five independent votes.

But a move in the Senate allowed him to replace an "opponent" with his own and

go from 2-5 to 3-4

.

The new members of the court were sworn in on Friday, September 11, before Casal himself.

The "cause" to prosecute the attorney is already underway.

It was conceived during those days of

Operation Puf -

advanced by the deputy Eduardo Valdés - through several NGOs that presented

different complaints against Casal

to Congress

,

especially for appointments and replacements that they consider incorrect and for other management issues, such as the creation from an area specialized in international terrorism.

What is remarkable is that the presentations of these NGOs have

identical arguments on the same issues,

which seem to be

copied and pasted

from the arguments that came out of the Popular Lawyers Front (FAP) plant, made up, among others, by militants of

La Cámpora, Justicia Legítima

and the

Evita Movement

and to which they adhere, among others, Juan Manuel Valdés -a Buenos Aires legislator and Eduardo's son, from

Operation Puf-

and Adrián Albor,

Luis D'Elía's lawyer.

Some of these NGOs also represent law firms in the north of the Province of Buenos Aires and south of Santa Fe, where prosecutor Juan Patricio Murray works, with strong ties to CELS and a founding member of

Justicia Legítima

, the organization of Kirchner magistrates to which Casal's predecessor, Gils Carbó belonged.

Murray is currently in the Human Rights Office of the Attorney General in Rosario.

The head of that office is Adolfo Villate, the prosecutor who brought the accusation against José María Campagnoli, finally dismissed by the same court that they now want to force to try Casal.

Campagnoli had been tried after being displaced when he was the prosecutor investigating the case known as

The Route of the K money

.

If the requests of these NGOs against Casal are successful, the space will open for the promotion of Abramovich, as Cristina's operators seek.

Another of the NGOs that denounced Casal is chaired by the lawyer Gastón Carrere, who argued technical issues in the letter but when he went to testify to Congress he only spoke of the slowness of the attorney to sanction Stornelli because he did not appear in Dolores, the true the thorn of Cristina's operators for

Operation Puf

.

Carrere was a partner in the Valdés study, the deputy who anticipated the maneuver against the cause of the notebooks by speaking on the phone with prisoner K Juan Pablo Schiavi.

That is,

an associate of the deputy who wants to turn the investigation of the notebooks against Cristina appears denouncing the attorney who wants to displace Cristina.

Deputy Eduardo Valdés, with Cristina Kirchner and Alberto Fernández.

Something else: another of the lawyers who denounces Casal is Natalia Salvo, representing an NGO whose

headquarters are the Instituto Patria itself.

Except, in addition, she is the lawyer of the

“retired agricultural producer”

whose testimony was used to set up

Operation Puf

against the notebooks in Dolores.

The world is a handkerchief.

With the arguments of all these NGOs, the Bicameral Commission for Monitoring and Follow-up of the Public Ministry began to initiate a trial for Casal, whom he began by calling the

temporary attorney

and then calling the

de facto interim attorney

and later calling, in the last sessions, the

prosecutor

, to dry

.

If he is a simple prosecutor and not the attorney, the obsession of impeachment to displace him would remain within the reach of the internal court that they now seek to reinforce with their own members.

The judging members who took office on Friday are four, two regular members and two alternates.

For the Senate, César Grau -advisor to the ultra-Kirchnerist deputy Rodolfo Tahilade- and his alternate Heliana Gualtieri, personal advisor to Senator Anabel Fernández Sagasti, Cristina's “spoiled” who announced the finally ill-fated expropriation of

Vicentín

.

And, for the Executive Branch, Héctor Recalde - Mariano's father, senator of

La Cámpora

- and his alternate Pablo Barbuto, undersecretary of Criminal Policy and man of the ultra-K Vice Minister of Justice Juan Martín Mena.

To prop up Casal's wear and tear, this week Cristina's majority in the Senate will vote on a resolution to file a criminal complaint, which the opposition has already anticipated its rejection of.

The criminal complaint is for not taking the oath to the members of the court who already took the oath on Friday.

That is, the majority of Cristina in the Senate

wants to denounce Casal, accusing him of not doing something he has just done.

The pressure is accelerating as the strategic value of the attorney grows: now the reduction of co-participation to the City that Horacio Rodríguez Larreta will take to the Court has burst onto the political agenda.

Before the court is issued, Eduardo Casal, the attorney that Cristina wants to see outside as soon as possible, should give her opinion.

Managing the button panel of the Procuratorate will mean, with the accusatory system, having the power to decide

what is investigated and what is not

, in addition to choosing with full powers

who investigates and who not a certain case.

The power to decide which judicial jurisdiction begins to apply the accusatory system is held by a bicameral commission managed by Cristina through Senator Fernández Sagasti, appointed to that position

on July 1, in the midst of the pandemic.

That was just the month in which the denunciations of the Kirchnerist NGOs against Attorney Casal began to appear en masse in Congress.

The body chaired by Fernández Sagasti could determine that now the system governs in the federal justice of Buenos Aires and automatically all the cases against the vice president and her allies - just as those that were presented against the Macri government - would remain at the rate that the government wants to impose on them. attorney on duty.

That

magic button

is the sparkling new jewel that the vice president would like to add to her personal jewelry box before the end of the year.
