The farmer had already applied in 2016 to be allowed to build this run with bays.

According to the plan at the time, this should be 92 square meters, as the head of the Hohenpeißenberg building department presented in the municipal council meeting.

At that time the local council had approved.

The building was supposed to be built outdoors, but because it serves the agricultural enterprise, it is to be regarded as privileged according to Section 35 of the Building Code and can be approved.

The farmer has started to build, but the planned 92 square meter extension has become more than twice as large: the exercise area with lying area is now 212 square meters.

"In principle, this is now a huge black building that has nothing to do with the approved plan," said Dorsch in the local council.

In order to change this situation retrospectively, the farmer has now applied for approval of his cultivation in retrospect: "There were plan changes and these should now be legitimized retrospectively," said the building authority manager Fischer.

From a legal point of view, subsequent approval is also not a problem because of the privileged status, as both cod and fishermen discovered.

Because if there are no legal reasons that speak against the building project, then the building can be approved - even if approval is only requested when the building is already in place.

“The legal is one thing, the way it went is another,” said the mayor: “It was simply built differently.

You don't do that. ”Most of the other farmers submitted their plans and would stick to them.

“Something completely different was built here without giving any indication.

It's a cowshed, but actually it's a mess, ”said Dorsch.

Nevertheless, the legal situation must be considered independently and from a legal point of view, subsequent approval is not a problem.

Most of the members of the Hohenpeißenberg municipal council saw it that way too: With four votes against, they decided to approve the building application retrospectively and with this vote it will now be forwarded to the district administration.
