Suicide of Evaëlle, 11, in Herblay: a teacher indicted for school harassment

Interviewed as part of the investigation into the suicide of Evaëlle, an 11-year-old schoolgirl, the teacher was placed under judicial control


It is undoubtedly unheard of in the history of National Education.

An investigating judge from the Pontoise judicial court (Val-d'Oise) indicted a teacher for harassment of a 15-year-old minor on September 4.

These are the consequences of the investigation opened after the death of Evaëlle, 11, in Herblay.

She hanged herself to her bed on June 21, 2019 after suffering several months of academic harassment at the Isabelle-Autissier college.

Her parents then filed a complaint against her French teacher who had been heard in police custody last November.

“We have the impression that we are listening to what we were saying.

We are starting to recognize what our daughter has gone through, ”reacts Sébastien, Evaëlle's father.

The teacher appeals her judicial review

"We are faced with a teacher who has 25 years of experience behind her and who has been indicted for harassment and not only against Evaëlle," said Me Delphine Meillet, lawyer for Evaëlle's parents.

Justice did what National Education had not done.

»Placed under judicial supervision, the teacher is prohibited from teaching and has an obligation to provide psychological care.

She must appeal these measures Thursday, October 1 in the morning before the Court of Appeal of Versailles (Yvelines).

Until recently, she had continued to teach and was preparing to continue her activity in Brittany where she had requested her assignment, even though acts of harassment had been reported after Evaëlle's death.

She did not respond to our requests.

National Education recognizes its responsibility

If the National Education has never temporarily suspended the teacher as requested by the parents, it has recognized its responsibility for what Evaëlle suffered.

The parents of the schoolgirl sent a request to the ministry which responded favorably and paid them compensation for moral damage in exchange for a commitment not to sue the state.

"It is clear that the support measures put in place to respond to the discomfort or even the distress of Evaëlle were not sufficient to prevent her from taking action", writes the rector of the academy.

"It is still the minimum given the situation, estimates Marie, the mother of Evaëlle.

Above all, they must learn the lessons and improve because the harassment is absolutely not contained.

The judicial investigation is still in progress.

It was opened on November 8, 2019 for manslaughter against X and for harassment of a 15-year-old minor against several students and Evaëlle's French teacher, one day after the latter's police custody.

The schoolgirl's parents believe that her behavior was central to the harassment their daughter suffered.

“Our suspicion is that the teacher started something in class and that the students continued afterwards,” says Marie, her mother.

From the first trimester, Evaëlle is taken to task by her French teacher because she does not use a notebook like her classmates but a binder, in accordance with the recommendations of an orthopedist to lighten her satchel after an ankle injury.

This singularity would have made the college girl the recurring target of humiliating remarks.

It's normal… ”she would have used to say to some of her students.

The teacher will defend herself later by arguing that it was humor.

"She was screaming for no reason at Evaëlle," some students have since confided.

"Evaëlle takes a high price in French lessons", warn several students when addressing her parents in November 2018. The latter have two meetings with the management of the establishment which do not lead to any protective measures.

But the students do not spare the young girl either.

She gets slaps on the back of the head, mocked, insults almost daily.

"We force his locker, we take his diary and read it in front of everyone," says his mother.

She spends her days alone, practically isolated.

In December, she finally confided in her parents.

“She tells us that in her class, she is the scapegoat,” says Sébastien, her father.

Evaëlle makes a list of 14 students in her class who harass her to varying degrees.

They will later learn that she attempted at this time to end her life by trying to set the house on fire.

Interviews to try to end his ordeal

Evaëlle's parents immediately contact the principal.

The latter proposes to implement the Pikas method.

Also called the “shared concern” method, it aims to find a positive way out of the bullying with each of the students involved, without accusing them.

Interviews take place in January.

“Afterwards, we discovered that it hadn't changed anything,” Sébastien remembers.

Evaëlle's parents believe that it was probably too late, and that the bullying was already too entrenched.

“And the conclusion of the Pikas method is that Evaëlle was not harassed!

Evaëlle's ordeal reached its climax the following month.

While waiting for the bus on February 6, her stalkers push her onto the roadway just before the bus arrives.

She gets up, pushes her attacker, who responds by sending him a slap.

A week later, she was pushed off a bench where she was sitting.

And when she sits down on the bench, she is thrown to the ground two more times.

These two episodes are the subject of written testimonies addressed to the principal educational adviser of the college, without effect.

"I lived the worst day of my life"

With her French teacher, the situation is also getting worse.

She decides to devote a "class life" session twice to Evaëlle.

“The theme was: why Evaëlle feels excluded and harassed by the class.

The pupils could ask all questions to Evaëlle and she had to answer, ”says Marie.

The schoolgirl complies, she faces the sneers of her classmates, bursts into tears.

"At one point, she can no longer answer and the teacher tells her:

Stop crying and answer the questions,

" she adds.

“She found herself like she was in court.

In this context, we tell him:

You are the problem, not the others,

”emphasizes Sébastien.

"I lived the worst day of my life", confides Evaëlle to her parents, after the second session of this type.

The couple learns on this occasion that the harassment has not stopped.

They ask that their daughter no longer take French lessons.

A few days later, they wrote to the school inspectorate to explain this situation and file a complaint against three students.

The latter have never been sanctioned for these facts.

Evaëlle obtains a transfer of establishment.

“In the new Georges-Duhamel college, while things were going well, she started to get heckled,” says Marie.

During an altercation, a student throws his things on the ground.

“It was an epiphenomenon but it was the last straw that broke the camel's back,” says the girl's mother.
