The 16-year-old defendant pleaded that he was a car wash worker and pleaded guilty to a crime of assault causing bodily harm.
There are 7 defendants in the same case, aged between 12 and 17. The girl and 4 of them have pleaded guilty to assault and violation of public morals and have been sentenced.
According to the case, the 13-year-old female defendant in the case learned in September last year that the victim X had passed her unseen nude photos to others, so she asked X to meet in Tianshuiwei on the 7th of the same month. The female defendant was with 6 other people at that time. The defendant was accompanied by a friend, and X apologized to the female defendant, but the female defendant and others were emotional and beat X together, and asked X to take off her pants to take pictures of her, and then the female defendant passed the photo to others.
X informed his mother afterwards and called the police.
The 16-year-old male defendant in this case was present with the female defendant that day. When he interceded, he said that he committed the crime on impulse and stupidity. He understood that violence should not be used to solve the problem and was willing to observe the curfew and other conditions during the probation period.
Magistrate Shui Jiali said that the victim's behavior was wrong, causing great harm to the person in the picture, and his behavior was immoral. She also believed that the defendant and others were violating the party and beating X, and their behavior was no different from the underworld, and that girls were also responsible for passing nude photos to X. Girls should not easily pass these photos to others.
The water officer also advised the defendant if he wanted to raise his head among friends, he should be a good person and work. If this method is not used, he was finally sentenced to 12 months probation, but also said that even if she is now sentenced to probation for the defendant, the Attorney General can file a review. Earlier, there were also defendants sentenced to probation. They were commuted to other penalties because the Court of Appeal deemed it inappropriate, so they urged the defendants to cherish the opportunity.
