The Supreme Court came to answer the accusations of Alberto Fernández for the application of the Micaela Law

The Supreme Court of Justice (CSJ) came out on Friday to respond to President Alberto Fernández, who complained that the highest court did not take care of implementing the provisions of the so-called Micaela Law, which establishes mandatory training in all areas of the State on gender perspective. 

"Since 2010, the Supreme Court of Justice of the Nation has led the training on Gender Perspective in the Judicial Power," they remarked through a statement prepared by Judge Elena Inés Highton de Nolasco.

The highest court recalled that in the field of Justice these steps began in 2009, when the Office for Women (OM) was created through the agreed 13. The area was in charge of Carmen Argibay until her death and is

now led by Highton by Nolasco.

"The Office for Women develops the coordination and management of training programs for the incorporation of the gender perspective both in the provision of justice services and in the field of labor relations that its exercise involves," they detailed. 

And they stressed that "since its creation it has carried out a process of sensitization in Gender Perspective and training on Domestic Violence, Due Diligence, Sexual Crimes in the context of crimes against Humanity, Trafficking in persons for sexual exploitation, Factors and Indicators of Domestic Violence, Language and Gender, among other activities ".

Likewise, the actions are complemented by the services of the Office of Domestic Violence.

It was created in 2008 and was "a pioneer and exemplary model of care for victims of violence worldwide," as highlighted in the Court.

Currently, it is also directed by Highton de Nolasco.

The CSJ thus rejected the proposals made earlier by President Fernández when leading an act.

"The Micaela law rebuilds us to understand the harmful effects of gender violence. I see with provocation that in the federal state, two of the three branches (Executive and Legislative) have made progress in implementing that law, but in the Judicial Branch

we have I asked the President of the Court (Carlos Rosenkrantz) to please deal with the issue and we only received silence,

The CSJ discredited the President by recalling that the gender perspective workshop they began to promote in 2008 "was validated by the United Nations and was also declared a good practice by the Organization of American States."

This training, which includes 16 hours of teaching, was even taken into account in the foundations with which the Micaela Law project was promoted.

"It is mentioned that the workshop, in addition to being used by the Judicial Powers, was' used for the training of legislative personnel, security forces, teachers, registration lawyers, and therefore could constitute a basis on which the organisms could work, making some adaptations' ", they recalled in the highest court. 


To dismiss Fernández's complaint, the Court added that "training, investigation, registration and mainstreaming activities are coordinated with all jurisdictions in the country."

"In pursuit of the training objective, once the workshops were designed, teams of replicators and replicators were formed in each jurisdiction. In 2016, the virtual classroom of the Office for Women was set up to teach workshops throughout the country ", they completed.

They added that this official report recognizes that "the provincial Offices for Women and Gender have also implemented their own training plans, adjusted to local realities."

"The work of the Office of Women is reflected in the Quarterly Report on Training of the Judicial Powers of Argentina in compliance with the 'Micaela Law where the articulation with those provinces that have Women's Offices or areas of gender '", they added.
