The U.S. Department of Homeland Security announced a proposed rule on September 24 to change the current "Duration of Status" for foreign students, exchange visitors, and foreign media representatives, suggesting that the maximum period of residence for international students should not exceed 4 years.

Under "Duration of Status", holders of the above visas can stay in the United States for as long as their status remains unchanged, and they do not need to apply for renewal.

The "Notice of Recommendations for Rulemaking" issued by the Department of Homeland Security intends to cancel this rule.

The department intends to establish a fixed permitted stay period for the three types of visas F (foreign students), J (exchange visitors) and I (foreign media representatives), as well as procedures for applying for extension of visas.

Under the proposed new regulations, holders of F or J visas will be able to stay in the United States until the end of their project, for a period of no more than 4 years.

The time for F category persons to prepare to leave the country has been reduced from 60 days to 30 days.

The U.S. Department of Homeland Security plans to introduce new regulations to further tighten the restrictions on foreign student visas.

Those who are deemed by the department to be from a "high retention rate" or "supporting terrorism" country can only stay in the United States for a maximum of 2 years.

The Department of Homeland Security's proposed changes to the Type I visa are to change the first residence period to a maximum of 40 days, and there is an opportunity to apply for an extension according to the relevant activity time, up to 240 days.

The proposed new regulations will be published in the Federal Register on September 25, local time.

The public can comment on the provisions 30 days before it takes effect.
