Attorney General Dr. Avichai Mandelblit expressed opposition to the promotion of emergency regulations by the government that would prevent demonstrations during the closure.
Mandelblit sent the opinion following the initiative of Health Minister Yuli (Yoel) Edelstein, after the delay in the legislative process in the Knesset.
In the opinion he wrote that such a move is unconstitutional and will not stand the legal test.
He added that the move should be promoted through legislation in the Knesset, in continuation of the High Court's policy.
Edelstein's move stemmed from the delay in amending the legislation in the Knesset.
According to the adviser, the regulations are intended to circumvent what he calls the "King's Road" which is ordinary Knesset legislation.
The councilor believes that the only "king's way" to restrict demonstrations for health reasons is through the completion of legislation in the Knesset, and in the meantime the police must enforce the rules of social distance and the wearing of masks.
The backing of the ombudsman is the deputy prime minister and defense minister Bnei Gantz, who in an interview with News 13 expressed strong opposition to the move to promote regulations. "We are not in the empire," Gantz claimed.
