One year after the SFP audit, Ana Guevara remains unscathed at Conade despite her 'sins'

The management of Ana Gabriela Guevara, one of the most illustrious Mexican athletes of all time, at the head of the National Commission for Physical Culture and Sports, has been dotted with scandals.

Corruption, diversion of resources, issuance of false invoices and extortion are some of the accusations that hang over her figure, once totemic, today questioned.

A large part of the complaints come from the audit carried out in 2019 by the Internal Control Body of Conade, the executing arm of the Ministry of Public Function within the body, to the Subdirectorate of Quality for Sports that, until August, was Directed by Israel Benítez.

The OIC informed Guevara and Benítez on September 27 of the findings of the investigation: a damage to the public treasury of 50.8 million pesos.

It took 286 days for the SFP to impose sanctions:

on July 9, it suspended Arturo Contreras, director of High Performance;

and on August 13 he dismissed Benítez.

Between both determinations, Guevara dispensed with the services of Contreras;

Carlos Ramírez, director of Fiduciary Operations;

and Sergio Monroy, deputy general manager.

But she remains unscathed.

A year after the audit, the SFP has not issued a single resolution that mentions Guevara, who knew about the anomalies that had occurred under his charge since at least September 27, 2019.

The doubts about the integrity of Guevara as a public official do not come from his time at the head of the body that governs Mexican sports.

Her history even goes back to her beginnings as an athlete, during the six-year term of Ernesto Zedillo.

Her closeness to the Vicente Fox administration (2000-2006) is proven in a controversial tax forgiveness that she enjoyed in the final stretch of the period.

After her retirement, in 2008, the Sonoran woman has served in a variety of public positions: deputy, senator, head of the Sports Institute and the Coordination of Sports, Physical and Health Culture of the Federal District during the leadership of Marcelo Ebrard, today Secretary of Foreign Relations and one of the central figures of the López Obrador government.

AS makes a compilation of the winding political path of Guevara a year after the SFP disclosed the irregularities in the distribution and verification of public funds in the body chaired by the former athlete.

She competed in the Universiade without being a university student

The XIX Universiade, held in 1997 in Sicily, Italy, marked the beginning of Ana Gabriela Guevara's career as a high-performance athlete.

The milestone, however, has its flats.

These Games, organized by the International Federation of University Sports (FISU), exclusively accredit athletes who study in higher education institutions.

in March 2020, the now director of Conade participated in the Universiade of Italy with the consent of the Autonomous University of Ciudad Juárez (UACJ).

This institution processed a "certificate of studies" that allowed the National Council for Sports Education to register it with the FISU.

The problem is that the Sonoran broker, as endorsed by law in the initial statement of assets that every official must present when entering the public administration, only certified that they had finished high school.

stipulates penalties, in the case of public documents, of four to eight years in prison and 200 to 360 days of fine.

Director of Conade without higher education studies

Guevara's academic record has been the subject of journalistic investigation, but it has not prevented him from assuming public office.

Although there is no legal requirement that stipulates a minimum standard of studies to occupy a seat in the Chamber of Deputies or in the Senate of the Republic, the world champion of 400 meters in 2003 accredits in the Legislative Information System having completed the high school.

The patrimonial declaration that she had to complete when swearing in as director of Conade denies it.

His school readiness came to the fore once more when he took office.

The transitional government of Andrés Manuel López Obrador appointed the Olympic medalist as general director of the Conade for the 2018-2024 administration in August 2018. Guevara protested on December 13 of the same year, although he did not formally begin to exercise until February of 2019.

Although the Law of Physical Culture and Sports and the Federal Law of Parastatal Entities do not oblige the owner of Conade to verify a minimum level of studies,

the Description and Profile of the Position (rules enshrined by the Resource Policy Unit Human Rights of the Federal Public Administration) does require, according to the guidelines still in force, a bachelor's degree.

AS also found that the current Job Profile (on the left) requires a minimum of experience of 12 years onwards in the following areas: public administration, national rights and legislation, social communications, administration, general economics, physical culture and sports and business organization and management.

However, Guevara did not meet this requirement either, as she assumed her first job after her sporting career in 2008, ten years before her appointment to head of Conade.

Her curriculum sheet, available on the National Transparency Platform, confirms this.

The Fox government intervened to unfreeze their bank accounts

Guevara has not only had the acquiescence of universities, but also of the country's tax authorities.

In October 2006, the Tax Administration Service (SAT) ordered the freezing of five bank accounts of the sprinter, who was still active at the time, due to omissions in his tax return.

The situation lasted less than a month, since in November their accounts were released.

documented that Guevara did not present any protection or enter a tax lawsuit, so the only way in which his resources were unfrozen must have been by express instruction of the Ministry of Finance or the President of the Republic, a position that Vicente Fox Quezada occupied. .

When only three months had passed since her retirement from the slopes, in April 2008, Ana Gabriela Guevara began her career as a public official.

It was Marcelo Ebrard, then head of government of Mexico City, who sheltered the former world champion and entrusted her with the coordination of Sports Culture, Physics and Health of the Federal District.

“I will not be behind a desk.

After 56 days, Guevara opened his office.

A race without obstacles, like the 400 meter dash.

On June 16 of the same year, the former athlete became the head of the Sports Institute of the capital.

Already in office, the Sonoran requested a two-week absence, without pay or per diem, to attend the 2008 Beijing Olympic Games as a commentator for ESPN.

Guevara argued that he had already acquired the commitment previously.

In addition, the new head of IDDF did not attend the meeting she had with the Sports Commission of the Legislative Assembly of Mexico City, in which she had to report on the progress of the 2008 Annual Operational Program and present the Regulations of the Education Law. Physics and Sports.

Guevara argued "involuntary communication errors."

Thus began a series of disagreements between the official and the Legislative Assembly, which escalated until Miguel Errasti Arango, a PAN deputy, accused that Guevara's Olympic license

violated article 12, section I of the Federal Law of Responsibilities of Public Servants.

Errasti even led a faction of the 'blues' that asked the head of government to remove Guevara from office.

However, Ebrard settled: "I don't see what the problem is."

During her stay at IDDF, Ana Guevara suffered from a shortage of budget.

In 2008, the agency received 150 million pesos.

The following year, the resources decreased to 70 million pesos.

Such a shortage caused him to be unable to activate the Plan for Physical Culture and Sports of the Federal District 2008-2012, the 'jewel' of his administration, as reported by

On February 12, 2009, she resigned from the IDDF to run as a candidate for the head of the Miguel Hidalgo Delegation on behalf of the PRD.

That was the official argument for her resignation.

Ana Laura Bernal, who served as Director of Monitoring and Social Communication, assumed the general management of the Institute.

Months later, Bernal requested maternity leave and Sergio Monroy, then deputy director of Regulations and Institutional Liaison with Conade, took command of the IDDF on an interim basis

The Sonoran, candidate of the PRD-PT-Convergence coalition, lost the delegational election of 2009 with the PAN Demetrio Sodi (39.4% against 33.45%).

The jurisdiction helps you ward off accusations of tax evasion

Guevara disappeared for three years from political life until Andrés Manuel López Obrador rescued her from ostracism.

It was on January 27, 2012 when the then presidential pre-candidate (for the second time) proposed her to occupy a senatorial office.

“I will make sport become a policy and not a lateral approach.

A state policy, a platform within the social discourse ”, he endorsed in a public act in which he accompanied the current President of the Republic.

Just one day before the endorsement, the SAT concluded a public auction of a house that belonged to the former developer, who still had a debt of 11 million pesos to the 'treasury', for fines and VAT and ISR surcharges.

Days before, the SAT had seized another address of the Sonoran.

The debt came from the "irregular" tax returns of 2004, 2005 and 2006, the same ones that earned her the freezing of her accounts.

Guevara obtained third place in the voting on July 1, 2012 (17.86%), behind the PRI Claudia Pavlovich (37.72%), current governor of Sonora, and the PAN Francisco de Paula (34.89%);

however, it entered the Senate under the principle of proportional representation.

Already invested with the constitutional jurisdiction, which makes her immune to any judicial procedure against her, the debts with the SAT disappeared from the media conversation.

As senator, Guevara chaired the Jurisdictional and Migration Affairs Commission, in which she incorporated Sergio Monroy as technical secretary.

She was also secretary of the Administration and Foreign Relations committees and a member of the Public Security, Government and Bicameral Committees for Dialogue and Conciliation in Chiapas.

After two legislatures (LXII and LXIII), she joined the third presidential campaign of Andrés Manuel López Obrador, in 2018.

The Morena-PT-PES political alliance nominated her for the deputation of electoral district 2 (Nogales, Sonora).

The popular vote now did favor her.

With 42.23% of the votes, well above the 28.30% scored by Humberto Jesús Robles, of the PRI, the ex-athlete extended her legislative life, and her jurisdiction.

On December 4, 2018, three months after taking her new seat, Guevara applied for a license to separate from the position;

the general direction of Conade already had her name.

Her seat was filled by Ana Laura Bernal, who also replaced Guevara at the helm of the IDDF 10 years earlier.

During her short period in the LXIV legislature, the former sprinter was absent in 10 of 19 votes in the first period of ordinary sessions of the first year.

We have already reviewed the fiscal and academic records that questioned the rise of the world champion in the 400-meter dash to Conade's leadership, but it is her work in function that has unleashed the hurricane

.

It all started when a month and a half before the Lima Pan American Games, the Guevara administration reduced financial scholarships to 30 high-performance athletes.

The agency explained that the cancellation of the support was due to a restructuring of the list of beneficiaries and the criteria for accessing the incentives.

Guevara also argued that there were "flying athletes" who collected from the Fund for High Performance Sports without complying with the rules.

He called them 'huachicoleros del deporte'.

AS confirmed this information and disclosed the identity of these athletes in August 2019.

Nabor Carrillo (judo) and Adriana Jiménez (high altitude diver) were two of the most vocal figures during the episode.

"It's a tantrum, all we did was adjust the programs that maintain the scholarships," excused Guevara before appearing before the Youth and Sports Commission of the Chamber of Senators, where he exposed the precarious budgetary situation that Conade is going through:

"I advance you that we are in the red.

We will no longer be able to pay for electricity ”.

It is an opportunity for the federal government to show that they are different (if they sanction Ana Guevara)

The shortcomings did not stop the conclusion of suspicious agreements and contracts that have become the main burden of management.

A report published by

on June 16, 2019, entitled 'Ana Guevara, in the lane of corruption', shook Conade.

The investigation details the looting of the resources of the High Performance Fund for Sports (FODEPAR) through a triangulation in which three companies participated (GC Rental Car, Proyectos Científicos y Tecnológicos del Sur, S. de RL, and Volare Travel Shop, SA de CV), together with the sports federations attached to Conade and three senior officials of the same Commission.

The plot worked as follows: the federation formally processes a request to receive money a couple of days in advance for a certain event, the three aforementioned firms finance the operation (with an extra cost and without a bid to acquire the contract), and Conade, Through FODEPAR, it reimburses the federations for a cost greater than the organization would have incurred if the request had been submitted more days in advance.

Israel Benítez (deputy director of Quality for Sports), Arturo Contreras (director of High Performance) and Faustino Jesús Díaz Muñoz (director of Support for Federations and Athletes) were the Conade officials referred to in the journalistic work.

Carlos Fernando Ramírez Barrera, director of FODEPAR and Fiduciary Operation, also enters the equation, who is in charge of releasing the funds.

An example of triangulation is found in the Mexican Federation of Taekwondo.

For the Puerto Rico Open, held in April 2019, the FMTKD would have requested a million pesos for a trip of four days and 22 people.

The Volare Travel Shop quote showed that each plane ticket would cost $ 28,600 pesos;

said company won the contract and billed each air ticket at $ 39,600.

The scheme is repeated, according to

The weekly also documented that the intruders issued false invoices to verify expenses, a

practice that on October 15, 2019 was classified as a 'serious crime' by the Chamber of Deputies and that deserves preventive detention ex officio.

The report left the ground prepared for another front: nepotism.

The same text revealed that people close to Conade executives were registered with FODEPA without proving reasons for it.

One particularly noisy case was Luz María Chávez, another member of Guevara's inner circle from the IDDF, who received a $ 35,000 scholarship as a “trainer” from swimmer Liliana Ibáñez, who lives in the United States.

On February 19, 2020, Irma Eréndira Sandoval, head of the Ministry of Public Function (SFP), appeared at the morning press conference at the National Palace to denounce the irregularities that the agency found in Conade.

The SFP, through the Internal Control Body, carried out seven audits that yielded 22 observations.

Of the seven, one corresponded to FODEPAR, of which six observations were issued;

five were still pending resolution.

The SFP's intervention in Conade began on June 17, 2019, when the president instructed the ministry to initiate an audit as a result of several citizen complaints, Sandoval said.

The audits began on July 1 and analyzed the January-June 2019 semester. Sandoval revealed that Conade did not provide all the information requested during the proceedings.

The investigation concluded on September 27 and the SFP set a deadline of December 2 to resolve the observations that certified a damage to the public treasury of 50.8 million pesos.

At the end of his presentation, Sandoval condemned the anomalies: "They reflect an activity that the Civil Service is unwilling to tolerate, which is the abuse of resources and non-compliance with the rules."

Regarding the issuance of false invoices to verify the looting of Fodepar's resources, the secretary said: "It is serious, due to the immorality that this entails."

However, Sandoval did not delve into other considerations: are the accused officials still in their posts? What happened after December 2, the deadline to resolve the observations?

The head of the SFP stated that she was already in the final stage of the audit analysis to later list which observations were not addressed.

The process would lead to a report on the assignment of administrative responsibilities.

The resolution was slowed down from May to July due to the COVID-19 pandemic, SFP sources confirmed to AS.

On July 1, 2020, the Internal Organ of Conade began audit number 12/2019, code 11139, with official description '370 "Subdirectorate of Quality for Sports" First semester 2019 ".

AS found that the investigation was already scheduled in advance and was part of the Annual Audit Program;

the Subdirectorate for Quality for Sports was going to be audited anyway, with or without presidential instruction.

In fact, in 2019, the Internal Control Body ordered four audits of Ana Guevara's administration and three in the last semester of the period by Alfredo Castillo, predecessor of the Sonoran in the general direction.

Israel Benítez, head of the instance, signed acknowledgment of receipt of the report of the results on September 27, 2019.

Said document was also addressed to Ana Guevara and the director of the Internal Organ of Conade, Filiberto Otero.

Therefore, Benítez and Guevara were already aware of the irregularities within the Commission since at least September 27, 2019.

Finally, the SFP removed Benítez from his obligations 321 days later, although the punishment was not obeyed by None of the observations related to FODEPAR, but rather for allowing people outside of Conade to use exclusive facilities for athletes.

that is, to present documentary evidence that the damage had been corrected and that the irregular practices were not repeated.

However, neither the Control Body, through the National Transparency Platform, nor the Ministry of Public Administration have shown what actions Conade took to mitigate the loss after December 2.

This medium tried on numerous occasions to contact Filiberto Otero: his staff excused that, due to the health crisis, he had been absent from his office and the SFP's Social Communication Coordination did not facilitate the interview.

'Steamed companies' that receive millionaire contracts

The new findings show that Conade entered into at least three contracts with companies created during the first year of AMLO's government

One of them is Ostergard Rensen Consultors SA de CV, made up of four partners, including María de Lourdes Karime Balut Escartín, former assistant to Ana Guevara in the Senate of the Republic and current employee of the Federal Electricity Commission.

The company was created on March 26, 2019, with only $ 4,000 of capital, and registered before a notary on April 10 of the same year.

With only two months of existence, Conade awarded him a contract, by direct award, of 1.4 million pesos for "legal, civil and immigration consulting services."

Other companies that repeated the modus operandi were Borgelund Consultores México, founded with $ 2,000 on April 2, 2019 and credited with a contract of 1.8 million pesos;

and IPM Investigación Estratégica Social, established in January 2019.

AS has a copy of the contract (folio SE-045-19) that Conade signed with Ostergard Rensen Consultors on June 6, 2019.

Representing the Commission are José Omar Hernández Pliego, in charge of the office of the Subdirectorate of Administration, and Marisela Rafael de la Cruz, Coordinator of Regulations and Legal Affairs.

For Ostergard signed Jesús Eberth Alonso Ruelas, who is also the majority shareholder of the company.

The contract was in force from June 1, 2019 and December 31 of the same year and stipulates in its initial declarations (II.8) that 'the provider' (Ostergard) will provide its documentation to the Ministry of Public Function and to the Organ Internal Control of the Conade.

During the exhibition on February 19, 2019, Secretary Sandoval did not consign the companies created 'steamed' winning millionaire contracts.

AS found that Ostergard is not listed in the federal government's Unique Registry of Suppliers and Contractors, not even as a 'company registered in Compranet'.

Friends and family of Conade officials receive salary

The budget is assigned to the Subdirectorate of Quality for Sports, which must allocate them, according to the operating rules, as an investment in favor of athletes and coaches.

On the other hand, the item has served to place friends and relatives of the directors of the Commission on the payroll, without any document endorsing the presentation of the contracted service.

The irregularities mainly point to Israel Benítez, who would have included, at least, 15 'aviators' paid at the expense of the treasury

one of the most notorious is Ricardo Salazar Benítez, the official's nephew, who received $ 31,000 a month.

A company denounces extortion by Conade to approve a contract

The accusations of diversion of funds, nepotism and corruption against Guevara and his entourage were joined by a new one: extortion.

On May 5, 2020,

El Financiero

reported a complaint filed with the Special Prosecutor's Office for the Attention of Complaints by Disappeared Persons of the State of Veracruz against the general director of Conade and Armida Adriana Ramírez, former Venezuelan priista and alleged Guevara's collaborator.

The plaintiff is Carlos Donaciano Solórzano Pineda, representative of the catering company Cocinas Industriales Multifuncionales de Calidad SA de CV (CIMCSA), based in Boca del Río, Veracruz.

The story began when Conade opened file 1964553 'Open Contracting of the Food Service for Athletes and Trainers', which fell into the hands of CIMCSA by direct adjudication.

The contract was active from August 14, 2019 to December 31 of the same year and its amount without VAT was $ 22,449,059.25.

Despite the fact that the type of file is "direct award", as can be seen in Compranet, Conade would have asked "extra requirements" to assign the contract, beyond the company complying with the technical specifications of the agreement.

According to

El Financiero,

CIMCSA's legal representative accused that Guevara and Monroy asked for $ 150,000 as a condition to authorize the contract and, in addition, 15% of the total value as consideration.

As of December 2019, Conade had not made any payments to CIMCSA, according to

and confirmed AS with another source.

It was not until December 31, when the Commission issued an invoice for $ 16,901,500, a figure that does not constitute the total amount of the original contract.

AS had access to a brief recording in which the source identifies Sergio Monroy;

the deputy director of Conade asks his interlocutor:

"If they don't offer what we are waiting for, they will be left without someone else."

The audio is part of the SFP investigation.

In February 2020,

reports

, Armida Adriana Ramírez demanded from CIMCSA a new payment, now of $ 2,900,000, for 'commission'.

Finally, the financial operator of the contract met with Donaciano on March 19, 2020 in a shopping center in Xalapa, Veracruz, where Ramírez used a representative of the public force ('Comandante Corona', according to the journalistic text) to force payment, physical threat through.

On March 25, Donaciano yielded and provided the money to the Civil Force element, whose current whereabouts are unknown.

As the Veracruz prosecutor's office did not refer the case to the Attorney General's Office, CIMCSA filed a second lawsuit, now at the federal level.

26 days had passed since the first complaint.

More than ten years in litigation for a house

As if that were not enough, Guevara still has another open question since 2008.

It is a judicial process derived from the purchase and sale of a furnished residence in the luxurious Los Encinos subdivision, in Lerma, State of Mexico

.

At that time, the former racer paid 4.5 million pesos and signed a contract with the owner of the property, Leticia Eugenia Melo Goytortúa.

However, Guevara never finished liquidating the payment, for which he accumulated several penalties.

The procedure lasted until October 2018, when the twenty-seventh Civil Judge in Mexico City, Carlos Miguel Jiménez Mora, ruled in favor of the current head of Conade.

The lawyer agreed with the Sonoran woman, arguing that Melo Goytortúa was the one who breached the deal, because "he never delivered the deeds."

All agree that the law should be applied regardless of names and that any omission would undermine the credibility of the government of the 'Fourth Transformation', which has made the fight against corruption its main banner.

Gálvez denounced Guevara before the Attorney General's Office for issuing the false invoices.

“The only thing I want to say to Ana Gabriela Guevara is that it is not an attack on her person.

The success of the lawsuit depends on the result of the (investigation) of the Public Function ”, he predicts.

If the SFP acquits Guevara, Gálvez will continue to fight, since, for this, the Secretariat would have to verify that Conade complied with correcting the anomalies:

“We would have to review what the solutions were.

If you submitted false invoices, what did you do to amend it?

Did you deliver new invoices?

Did you return the money?

It would be necessary to analyze what the final ruling is and, if there are inconsistencies in the information, the Office of the Attorney General of the Republic is obliged to investigate them ”.
