The defense attorneys of the Elowitz couple today (Tuesday) asked the Jerusalem District Court to postpone the stage of filing preliminary applications in the 4000 case - until the disputes with the State Attorney's Office regarding the investigation materials are resolved.
This, among other things, is because it was revealed today that the State Attorney's Office did not forward to the defense attorneys some of the emails between Ilan Yeshua and Lahav 433
.
Earlier today, the court ruled that a hearing regarding the investigation materials would be held only on November 15.
This means that if the defense attorneys' request is granted, the preliminary filing stage will be postponed for at least a month, which may also affect the beginning of the evidentiary stage.
In recent weeks, all the defense attorneys in the case have submitted various requests for the transfer of additional investigative materials and for the disclosure of classified evidence.
Due to this, as stated, a hearing on the matter was scheduled for mid-November.
In deciding to set the hearing, the defense attorneys for the Elowitz couple, attorneys Michal Rosen Ozer and Jacques Chen, requested that the court allow them to file the preliminary arguments only after the proceedings concerning the investigation materials are completed.

According to the defense attorneys, the order of the court - in which they will be required to file preliminary claims before receiving the full materials of the investigation, which they claim they are entitled to receive - "poses a real difficulty to the defendants and constitutes a violation of their rights."
Attached to the request was a notice sent today from the State Attorney's Office to all the defense attorneys in the Alps cases.
