After five unsuccessful attempts they investigated Pablo Moyano, but he refused to testify

After five calls to declare that with different proposals he managed to postpone, this Wednesday Pablo Moyano had no choice and appeared before the prosecutor Sebastián Scalera, to be investigated in the case where he is accused of being the

head of an illicit association that defrauded in figures millionaires to the Independent Club

.

The hearing was held online, with the presence of Judge Brenda Madrid and the defense in charge of Daniel Llermanos.

After the more than three hours that the reading of the accusations demanded,

the son of the leader of Truckers refused to testify.

The sixth was the charm.

The appointment was virtual, since hours before the day set for the hearing in person, the defense presented a medical certificate explaining that

being a hypertensive person, it was recommended that he not expose himself

.

Consequently, despite having criticized the platform proposed by the prosecution, it was finally the one that was used.

The investigation began after 10:30.

One of the secretaries and the representative of the Public Prosecutor's Office alternated in reading the accusation against Pablo Moyano and all the evidence of the case.

Of all of them, he decided not to defend himself in this instance, and

refused to answer questions. 

The first thing that was read to him was the so-called "Fact 1" that appears in the imputation, according to which "from an undetermined date and at least until November 2017, an illicit association operated, made up of a variable group and not determined of male and female people, all of legal age, being part of it, on the one hand, a faction of the fans of the Club Atlético Independiente (“barra brava”), who regularly met on the occasion of football matches ( ...) on the other hand, executives, employees, partners and some supporters of the Independent Athletic Club turn out to be part of said criminal organization ".

In this much broader structure,

the vice president of the sports entity, along with Pablo "Bebote" Álvarez, played a preponderant role for the prosecution

as leader of Independiente's "bar brava".

Scalera also involved Roberto "el Polaco" Petrov, Noray Nakis;

Héctor "Yoyo" Maldonado, Juan Eduardo Lenczicki, and Damián Horacio Lagaronne.

All this group of people, already processed and sent to oral trial, were -according to the accusation- "those in charge of executing and organizing the members in the actions according to the rules issued by the bosses."

Pablo Moyano also heard what the alleged illicit association was doing: to "

defraud the Independent Athletic Club through the management, obtaining, hidden printing and reselling of tickets

," protocols "for accessing the sports events of said institution, bonuses and social fees outside the corporate sphere and without entering the economic product into the Club's patrimony ".

On the other hand, the organization headed by Pablo Moyano for justice was also dedicated to "

extorting, coercing, threatening and intimidating

, through the use of physical, verbal or firearms violence, the authorities of state or private organizations in charge of the security of sporting events, as well as technical directors, members of the coaching staff, soccer players and some managerial authorities of the Independent Athletic Club ".

As the hours passed, the son of Hugo Moyano heard during the investigation the extension of the accusation against him, which led him again to appear before the prosecutor.

The first investigation was in 2018, but as more crimes were attributed to him, he had to be investigated for them.

Thus, Moyano is also being investigated for

having hired a construction company that belonged to the Moyano clan, Aconra SA

, to finish works at the Independiente stadium with alleged surcharges.


For the prosecutor Scalera, they worked "en masse, in order to

take over, exclusively, the public space around the stadium

of the Independent Athletic Club in order to obtain economic revenues with the management of grills and other street stalls and the charging money to park on public roads ".

They are also credited with having "illegitimately generated and obtained access concessions to sporting events and other social activities of the Independent Athletic Club."
