The unexpected decision of the Court has several messages but none is comparable to the one sent to Cristina Kirchner: it tells her without saying that
Justice is one of the three powers and that it cannot be overwhelmed.
It is indeed what the vice president was doing.
In three acts, Cristina managed to get the Magistracy to annul a dozen transfers of judges in the macrismo, for the Senate to target
only the three that bother her
and behind a card that Alberto Fernández flew them by decree.
It was dedicated to naming the replacements.
The problem: in the middle was the Court.
Cristina
achieved the miracle of having the five members of the Tribunal vote together.
And the proof of the miracle is how they got to vote together.
Former President Lorenzetti and Rosatti could have voted to zoom from Santa Fe as they have done
throughout the quarantine.
The fact of having come to Buenos Aires to meet at the Court is a sign.
And the fact that President Rosenkrantz found out about the trip
when they were here
is also another sign, but of
the internal rift.
Less did Rosenkrantz know how they were going to vote.

Rosenkrantz considered that the two central conditions for per saltum had been met.
That is, institutional gravity and urgency: that the damage cannot be repaired or that the repair arrives late.
And in his vote he argued that the transfer of three judges was not being discussed, but of
many more that the Government wants to charge.
Christianity bombarded Rosenkrantz's positions until the last minute.
And Alberto Fernández asked: “What is Rosenkrantz looking for?
Anyone who has studied law knows that this is a legal scandal ”.
A scandal is that the President of the Nation attacks the President of the Court in this way.
He also said that the honking in front of Lorenzetti's house was "pressure and the most vile of fascism."
And what do you call what your minister Losardo did, who before the Court meeting said: "Enabling per saltum would be a scandal"?
Scandalous pressure.
Nothing that happened in the Court would have happened if on Monday the judges of the Litigation Chamber decided if Bertuzzi, Bruglia and Castelli were well or badly removed from their posts.
As there was a surprise tie, the Court had to decide on the per saltum.
Several did not want to know anything about the per saltum or to
get in trouble with the government.
But if they rejected the per saltum they were going to get into the trouble of
paying the great cost
of being stuck with Christianity, especially after having approved in 2018 the transfer of the judges that Cristina seeks to overthrow.
The per saltum is there but it is still necessary to know what the Court decides on the fate of the judges.
There it will be known who won and who lost
in this story, although the brakes have already been put on.
